Ian,
I just responded to your additional information request last week and hopefully you received
it by now. However, in reviewing the updated information related to the NC EEP program, I
made an error in not realizing the statute applies to projects submitted to your group after
October 1, 2008. 1 had August in my mind as the submittal as that is when the application
was signed. Based on that thought, I subsequently obtained a renewed fee approval from
the NC EEP. Upon looking at my files and reading your letter more closely I realized we just
missed that grandfathered cutoff date.
I've informed Kelly Williams by telephone about this misunderstanding and already
contacted a private mitigation bank. Thus please hold the PCN application until I can
resolve this issue with the mitigation payment. I would not expect it to take too long to
provide you a different mitigation payment acceptance form if the private banks have a
process as simple as the NC EEP. Yet, this is new to me too. Please inform me if this will be a
problem on your end.
