APPROVAL OF MODIFIED STORMWATER MANAGEMENT PLAN
Dear Mr. Miller:
On February 7, 2006, the Division of Water Quality (DWQ) issued a 401 Water Quality Certification for
impacts to surface waters in order to construct the Heritage Pines Subdivision in Wake County. Condition
Number 3 of the General Certification requires the submission and approval of a stormwater management
plan for this project. On May 2, 2006, the DWQ approved a Stormwater Management Plan for this
project to meet Condition Number 3.
On April 24, 2009, the DWQ received a revised stormwater management plan, dated April 22, 2009,
submitted by the consulting engineer Mr. Brad Haertling of Hugh J. Gilleece & Associates PA. This
revised stormwater management plan has been reviewed and satisfies the stormwater management
requirements of the 401 Water Quality Certification.
The structural stormwater practices as approved by DWQ as well as drainage patterns must be maintained
in perpetuity. No changes to the structural stormwater practices shall be made without written
authorization from the DWQ. Stormwater easements shall be recorded for a distance of at least 10 feet on
each side of all storm water conveyances on all lots containing these structures including future access for
maintenance. The stormwater easements shall allow for the ability to maintain the structures, perform
corrective actions as described above and shall provide protection of the structures from potential.
alternations by future property owners. All operation and maintenance activities shall be followed as
stipulated in the signed and notarized Operation and Maintenance Agreement.
