Becker, President Aqua North Carolina, Inc. 202 MacKenan Court Cary, NC 27511 Subject: Request for Additional Information Permit No.WQ0037600 Legacy Phase 5A Chatham County Dear Mr. Becker: The Division recently completed a preliminary review of the submitted final engineering certification for the above permit. Based on the submitted record certification and as-built drawings for the subject project (WQ0037600), it appears that there are discrepancies between the permitted and constructed project as well as incomplete certifications for the entire project. However, no permit modification was requested for this project and no additional certifications have been received to date. Please submit a complete response to this office for the following items: 1. The submitted record drawings indicate that approximately 598 linear feet(LF)of 2-inch pressure sewer was installed. Note that the permit was issued for the installation of approximately 477 LF of 2-inch pressure sewer.As no permit modification was submitted, it is unclear to the Division why the length of 2-inch pressure sewer as installed varies from the permitted amount by approximately 20%. Please explain the deviation from the originally permitted length of 2-inch pressure sewer line, and why the final certification was submitted with no indication as to this deviation. [see Condition 1.7 per Permit No. W00037600] 2. The originally permitted drawings as well as the record drawings indicate that this cul-de-sac(Part 2) is a terminal portion of this project, requiring certification of the downstream pressure sewers prior to operation of this section of the project per 15A NCAC 02T.0116.To date, no such certifications have been received. Please provide these certifications as soon as possible. 3. A permit modification request with application fee must be submitted to the PERCS Unit in the Central Office for this project. Hydraulic calculations/modeling indicating that the alterations in 2-inch pressure sewer line length (as well as any other possible deviations to other portions of the project)do not adversely affect the overall operation of the system will be required as well.These items should be submitted as soon as possible. It is the Division's expectation that the certifying professional engineer certifies that"the permitted facility has been installed in accordance with the rules, any minimum design criteria except as noted, and approved plans and specifications." Furthermore, it is the also Permittee's responsibility to ensure that the project has been constructed pursuant to the applicable standards and requirements via the documentation provided by the engineer. Please note that failure to comply with the issued permit may result in penalties in accordance with North Carolina General Statute§143-215 6A through §143-215.6C,construction of additional or replacement wastewater collection facilities,and/or referral of the North Carolina-licensed Professional Engineer to the licensing board.
