Reference your application for a Department of the Army permit
to maintain an access channel and boat basin, relocate a section
of a pier and maintain a breakwater structure on Back Sound
adjacent to property off S. R. 1335, Harkers Island, Carteret
County, North Carolina.
Your proposal has been reviewed and found to be consistent
with the provisions and objectives of general permit No. SAWC080-
N-000-0291. Therefore, you may commence construction activity in
strict accordance with applicable State authorization and the
enclosed plan. Failure to comply with the State authorization or
conditions of the general permit could result in a violation of
Federal law.
If any change in your work is required because of unforeseen
or altered conditions or for any other reason, plans revised to
show the change must be sent promptly to this office and the N. C.
Division of Coastal Management prior to performing any such change
or alteration. Such action is necessary as revised plans must be
reviewed and the authorization modified.

attached plats, 3, sheets 1-2 of 2 and "Attachment" dated 10/9/85.
This permit, issued on 1 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
pemtittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) In order •to- protect juvenile fisheries species, no excavation will be
permitted between the dates of April 1 through September 30 of any year
without the prior approval.of the N. C. Division of Coastal Management.
(2) All excavated matgrials will be confined landward of the mean high water
elevation and any regularly or irregularly flooded marshlands.
(3) No marsh vegetation will be excavated or filled.
(4) Excavation will not exceed 3 feet below the elevation of mean low water
(MLW).
(5) The activity shall be conducted in such a manner as to prevent significant
increases in turbidity outside of the area of construction or construction-
related discharge.
(6) The disturbed areas will be properly graded and provided a ground cover
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31, 1989
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:

Carolina Division of Coastal Management.
b. All excavated materials will be confined landward of the

9. Narrative description
.The applicant's property is a tract about one acre in size located
between Back Sound and SR 1335 on Harkers Island in Carteret County.
The property is characterized by 3-6' elevation and sandy soils. Vege-
tation consists of live oaks and other thick, understory species.
Near the shoreline the property is maintained as a yard and non-tidal
salt meadow ,grows in particularly sandy spots.

The applicant constructed an open water breakwater protective basin
immediately offshore of the tract under the Corps of Engineers au-
thorization in 1975. The basin is accessed by an "L" shaped pier.
With the permit request the applicant is proposing to use a small drag
bucket operated by a portable double-drum.winch on shore to maintain
the interior perimeter of the basin to -205' MLW. A small section of
pier is to be relocated within the basin and an open section of the
bulkheaded breakwater, currently used for ingress and egress, is to
be closed with similar breakwater material. A new 15' wide by 60'
long by 2.5' deep access channel is planned immediately outside of the
east wall of the breakwater to facilitate entrance and exit.
All excavation will be done with the "Saverman" method described
above, and the applicant has provided information in the application
package relative to this.
10. Anticipated impacts
Conducting the project as proposed will result in the disturbance of
8,000 sq.ft. of shallow, subtidal bottom and deepening to a uniform
-2.5' MLW. Of this- area the majority is suspected to have been pre-
viously excavated except for the 900 sq.ft. that will be excavated
,,for the new access channel, About 300 cu.yds. will be removed from
the sound bottom and deposited over 5,600 sq.ft. of high ground.

On January 27, 1981, we issued general permit No. SAWC080-N-
000-0291 (enclosed), which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received October 28, 1985, for a
Department of the Army permit to maintenance dredge an existing
boat basin and access channel in Back Sound at your property off
State Road 1335, Harkers Island, Carteret County, North Carolina,
indicates it to be a candidate for Federal authorization under
this general permit. Accordingly, the administrative processing
of your application will be accomplished by the North Carolina
Division of Coastal Management. Comments from Federal review
agencies will be furnished to the State.
If your application must be withdrawn from this general
permit process for any reason, you will be written and informed of
its further management. If there are no unresolved differences of
State-Federal positions or policy, the final action taken on your
application by the State will result in your receiving written
notice from us that your application has been successfully
processed under our general permit. Only after receiving such
confirmation should you begin work.
Your application, pursuant to Section 10 of the River and
Harbor Act and Section 404 of the Clean Water Act, has been
assigned No. SAWC086-N-016-0027 and will be coordinated by

Enclosed is the application of Bartow K. Pierce, Jr. for a
Department of the Army permit and a State Water Quality
Certification to accomplish work in Back Sound, Harkers Island,
Carteret County, North Carolina. Your receipt of this letter
verifies your acceptance of a valid request for certification in
accordance with Section 325.2(b)(ii) of our administrative
regulations.
We are considering authorization of the proposed activity
pursuant to Section 404 of the Clean Water Act, and we have
determined that a water quality certification may be required
under the provisions of Section 401 of the same law. A Department
of the Army permit will not be granted until the certification has
been obtained or waived.
In accordance with our administrative regulations, 60 days
after receipt of a request for certification is considered a
reasonable time for State action. Therefore, if your office has
not acted on the request by December 30, 1985, the District
Engineer will deem that waiver has occurred.

ADJACENT RIPARIAN LANVOWNERS STATEMENT
General Statute 113-229 requires that riparian landowners with
property adjoining a proposed excavation and/or fill project be given
thirty (30) days in which to comment on the.project. This form al-
`lows the adjacent riparian landowner to express either: (1) that he
objects to the project or, (2) that he does not-object and desires
to waive his right to the 30-day period so that the processing of the
application can progress more rapidly. Of course., the adjacent ri-
parian landowner need not sign this form at all if he so chooses.

The Subject application has been reviewed for water quality impacts
and the following comments are offered:
1. The proposed project will not require a 401 Certification.
2. The applicant should maintain as much separation as possible
between the spoil area and adjacent potable wells to minimize
potential for contamination of the water supplies.
3. The activity should be conducted in such a manner as to
prevent significant increases in turbidity outside of the area
of construction or construction-related discharge (increases
of 25 NTU's or less are not considered significant).

The applicant proposes to maintenance excavate a 60 foot by 15 foot
entrance channel, and a 90 foot by 75 foot boat basin to a depth of -2.5 feet
below MLW. Spoil is to be placed on highground adjacent to the project and
should consist of 283 cubic yards. The project location is within Back Sound,
classified SA.
The project has been reviewed to determine impacts to water quality. The
following comments are provided:
1. The project will not require 401 certification.
2. The applicant should maintain as great a distance as possible between
potable wells and the spoil disposal area to avoid possible contamination
of water supplies.
3. This office has no objection to the project as proposed.

The applicant's property is a tract about one acre in size located
between Back Sound and SR 1335 on Harkers Island in Carteret County.
The property is characterized by 3-6' elevation and sandy soils. Vege-
tation consists of live oaks and other thick, understory species.
Near the shoreline the property is maintained as a yard and non-tidal
salt meadow ,grows in particularly sandy spots.
The applicant constructed an open water breakwater
immediately offshore of the tract under the Corps

With the permit request the applicant is proposing to use a small drag
bucket operated by a portable double-drum winch on shore to maintain
the interior perimeter of the basin to -2.5' MLW. A small section of
pier is to be relocated within the basin and an open section of the-
bulkheaded breakwater, currently used for ingress and egress, is to
be closed with similar breakwater material. A new 15' wide by 60'
long by 2.5 deep access channel is planned immediately outside of the
east wall of the breakwater to facilitate entrance and exit.
All excavation will be done with the "Saverman" method described
above, and the applicant has provided information in the application
package relative to this.
Anticipated impacts
Conducting the project as proposed will result in the disturbance of
8,000 sq.ft. of shallow, subtidal bottom and deepening to a uniform
-2.5' MLW. Of this''area the majority is suspected to have been pre-
viously excavated except for the 900 sq.ft. that will be excavated
for the new access channel. About 300 cu.yds. will be removed from
the sound bottom and deposited over 5,600 sq.ft. of high ground.
The "Saverman" excavation method is expected to produce slightly more
turbidity than a typical dragl.ine excavation of a similar size due to
the distances this spoil must be moved under water. It is not expected
that the turbidity increase will be significant especially if the pro-
ject is timed for periods of the year in which there is little biolo-
gical activity. _
