Therefore, you may commence construction activity in strict accordance with applicable State authorization and the enclosed plan. Failure to comply with the State authorization or conditions of the general permit could result in a violation of Federal law. If any change in your work is required because of unforeseen or altered conditions or for any other reason, plans revised to show the change must be sent promptly to this office and the N. C. Division of Coastal Management prior to performing any such change or alteration. Such action is necessary as revised plans must be reviewed and the authorization modified. (1) In order •to- protect juvenile fisheries species, no excavation will be permitted between the dates of April 1 through September 30 of any year without the prior approval.of the N. C. Division of Coastal Management. (2) All excavated matgrials will be confined landward of the mean high water elevation and any regularly or irregularly flooded marshlands. (3) No marsh vegetation will be excavated or filled. (4) Excavation will not exceed 3 feet below the elevation of mean low water (MLW). (5) The activity shall be conducted in such a manner as to prevent significant increases in turbidity outside of the area of construction or construction- related discharge. (6) The disturbed areas will be properly graded and provided a ground cover (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1989 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Narrative description .The applicant's property is a tract about one acre in size located between Back Sound and SR 1335 on Harkers Island in Carteret County. The property is characterized by 3-6' elevation and sandy soils. Vege- tation consists of live oaks and other thick, understory species. Near the shoreline the property is maintained as a yard and non-tidal salt meadow ,grows in particularly sandy spots. g ass The applicant constructed an open water breakwater protective basin immediately offshore of the tract under the Corps of Engineers au- thorization in 1975. The basin is accessed by an "L" shaped pier. With the permit request the applicant is proposing to use a small drag bucket operated by a portable double-drum.winch on shore to maintain the interior perimeter of the basin to -205' MLW. A small section of pier is to be relocated within the basin and an open section of the bulkheaded breakwater, currently used for ingress and egress, is to be closed with similar breakwater material. A new 15' wide by 60' long by 2.5' deep access channel is planned immediately outside of the east wall of the breakwater to facilitate entrance and exit. All excavation will be done with the "Saverman" method described above, and the applicant has provided information in the application package relative to this. 10. Anticipated impacts Conducting the project as proposed will result in the disturbance of 8,000 sq.ft. of shallow, subtidal bottom and deepening to a uniform -2.5' MLW. Of this- area the majority is suspected to have been pre- viously excavated except for the 900 sq.ft. that will be excavated ,,for the new access channel, About 300 cu.yds. will be removed from the sound bottom and deposited over 5,600 sq.ft. of high ground. Project summary 9. Narrative description 10. g ass The applicant's property is a tract about one acre in size located between Back Sound and SR 1335 on Harkers Island in Carteret County. The property is characterized by 3-6' elevation and sandy soils. Vege- tation consists of live oaks and other thick, understory species. Near the shoreline the property is maintained as a yard and non-tidal salt meadow ,grows in particularly sandy spots. The applicant constructed an open water breakwater immediately offshore of the tract under the Corps thorization in 1975. The basin is accessed by an protective of Engineer "L" shaped pier With the permit request the applicant is proposing to use a small drag bucket operated by a portable double-drum winch on shore to maintain the interior perimeter of the basin to -2.5' MLW. A small section of pier is to be relocated within the basin and an open section of the- bulkheaded breakwater, currently used for ingress and egress, is to be closed with similar breakwater material. A new 15' wide by 60' long by 2.5 deep access channel is planned immediately outside of the east wall of the breakwater to facilitate entrance and exit. All excavation will be done with the "Saverman" method described above, and the applicant has provided information in the application package relative to this. Anticipated impacts Conducting the project as proposed will result in the disturbance of 8,000 sq.ft. of shallow, subtidal bottom and deepening to a uniform -2.5' MLW. Of this''area the majority is suspected to have been pre- viously excavated except for the 900 sq.ft. that will be excavated for the new access channel. About 300 cu.yds. will be removed from the sound bottom and deposited over 5,600 sq.ft. of high ground. The "Saverman" excavation method is expected to produce slightly more turbidity than a typical dragl.ine excavation of a similar size due to the distances this spoil must be moved under water.
