Dear Mr. Pearsall:
Reference your application for a Department of the Army
permit to construct piers and docks, and a camierical marina on
the Northeast Cape Fear River near Castle Hayne in New Hanover
County, North Carolina.
Your proposal has been reviewed and found to be consistent
with the provisions and objectives of general permit No. SAWL''080-
N-000-0291. Therefore, you may commence construction activity in
strict accordance with applicable State authorization and the
enclosed plan. Failure to comply with the State authorization or
conditions of the general permit could result in a violation of
Federal law.
If any change in your work is required because of unforeseen
or altered conditions or for any other reason, plans revised to
show the change must be sent promptly to this office and the N. C.
Division of Coastal Management prior to performing any such change
or alteration. Such action is necessary as revised plans must be
reviewed and the authorization modified.

the end of Blossom Ferry Road as requested in the permittee's application dated rec. 3/6/85 including
attached plats, sheets 1 and 2 of 2 dated received 3/6/85.
This permit, issued on ?/? / , is subject to compliance with the application (where consistent
with the permit), all applic6ble regulations, special conditions and notes set forth below. Any violation of these terms may subject
pennittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) A 15' setback will be observed from the westernmost floating dock and the
adjacent property line.
(2) No attempt will be made by the permittee to prevent the full and free use
by the public of all navigable waters at or adjacent to the authorized structure.
(3) The marina will display a sign showing the location of the nearest pumpout
facility, listing the telephone numbers of local septic tank pumping services
and including other appropriate waste disposal information.
(4) The marina shall prominently post and enforce a locked-head policy for boats
without holding tanks.
(5) All floating structures, other than boats, used for habitation or commerce
(as defined in 15 NCAC 7M.0602) shall be in conformance with local regulations
for onshore sewage treatment.
(6) Fueling facilities will be designed, located, and supervised to prevent
fuel and oil spills into public waters. An attendant will be present at
all times during hours of operation.

This penYi`it action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31; 1988
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

- - ADDITIONAL CONDITIONS
NOTE: If not otherwise provided for by law, the display of lights and signals
on the structure should be as prescribed by the U. S. Coast Guard. Any
required lights and signals should be installed and maintained by, and
at the expense of,the permittee.
NOTE: The permittee should recognize the possibility that the permitted structure
may be damaged by wave wash from passing vessels. The issuance of this
permit does not relieve the permittee from taking all proper steps to
ensure the integrity of the structure and the safety of moored boats from
damage by wave wash. The permittee will not hold the United States or
the State of North Carolina liable for any such damage.
NOTE: The existing septic tank system will need improvement since the proposed
construction will increase the design sewage flow. This will require
appropriate permits from the New Hanover County Health Department.
NOTE: The project site is located in an area having a high probability of containing
submerged cultural resources. If such materials are encountered, the
permittee must immediately stop work and notify the District Engineer,
Wilmington Corps of Engineers, 343-4629 and the N. C. Division of Coastal
Management at 733-1664 in Morehead City.

Reference the application of Mr. Robert J. Pearsall for a
Department of the Army permit to construct piers and docks and a
commerical marina on the Northeast Cape Fear River near Castle
Hayne, New Hanover County, North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. No attempt will be made by the permittee to prevent the
full and free use by the public of all navigable waters at or
adjacent to the authorized structure.
b. If not otherwise provided for by law, the display of
lights and signals on the structure, will be as prescribed by the

On January 27, 1981, we issued general permit No. SAWCO80-N-
000-0291 (enclosed), which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received March 5, 1985, for a
Department of the Army permit to construct piers and docks, a
commerical marina, on the Northeast Cape Fear River near Castle
Hayne in New Hanover County, North Carolina indicates it to be a
candidate for Federal authorization under this general permit.
Accordingly, the administrative processing of your application
will be accomplished by the North Carolina Division of Coastal
Management. Comments from Federal review agencies will be
furnished to the State.
If your application must be withdrawn from this general
permit process for any reason, you will be written and informed of
its further management. If there are no unresolved differences of
State-Federal positions or policy, the final action taken on your
application by the State will result in your receiving written
notice from us that your application has been successfully
processed under our general permit. Only after receiving such
confirmation should you begin work.
Your application, pursuant to Section 10 of the River and

quality, the following comments are offered:

2. It is recommended that marine pump-out facilities be constructed
and the use of these facilities strictly enforced in order to
protect water quality.

8. Project summary The applicant proposes to convert the use of his property from single-
family residence to a combination of single-family plus a commercial facility to
provide docking and gas service to boats using the Northeast Cape Fear River.

9. PROJECT DESCRIPTION:
The project is located on property on the south side of the Northeast Cape Fear
River upstream of the existing U.S. 117 crossing of the river at Castle Hayne.
There is an existing single-family residence located on the property at the top
of the river bluff and an, existing one-story concrete building located near the
river. The shoreline is typical of the wooded swamp throughout this area and
bas no coastal wetland species associated with it. The applicant shows in his
plans that the river depths range from 2'-20' within the project area.
At the present time the applicant proposes to construct a double arm pier and dock
combination from his highground into the river. A 60' long x 6' wide fixed pier
with a 36' x 6' "L" will be constructed. Two 30' Long x 6' wide floating docks
will be connected to the "L". A gas pump with a long service hose will be at the
landward end of the fixed pier. The existing block building will be converted to
a "store" and restroom facility. A septic tank with lift pump will be installed
to serve the "store". The effluent from this tank will be pumped up the hill to
a presently installed septic tank system.
The applicant also proposes to construct his own new private residence and to
establish a mobile home on the property at some future time.
10. ANTICIPATED IMPACTS:
If the project is completed as proposed no adverse impacts on coastal resources
are anticipated. Although the applicant has indicated that this facility is a
marina it does not appear to exceed the 10 boat minimum found in coastal regula-
tions. The pumping of gas at the dock could result in the potential discharge
of petroleum products into the waters of the state.
