Your proposal to excavate at all three sites has been reviewed and found to be inconsistent with the provisions and objectives of general permit No. SAWCO80-N-000-0291. Authorization is not provided for excavation at site 2. State authorization was provided for excavation of the channels, canals and basins indicated as sites 1 and 3 on your plans, and this limited work is consistent with our general permit. Therefore, you may commence construction activity at sites 1 and 3 only, and the work must be in strict accordance with applicable State authorization and the enclosed plan. Failure to comply with the State authorization or conditions of the general permit could result in a violation of Federal law. If any change in your work is required because of unforeseen or altered conditions or for any other reason, plans revised to show the change must be sent promptly to this office and the N. C. Division of Coastal Management prior to performing any such change or alteration. Such action is necessary as revised plans must be reviewed and the authorization modified. (1) This permit does not authorize the excavation of the channel, canal or basin shown as site 2 on the attached plats and is hereby deleted. Work at sites 1 and 3 is authorized. (2) No wetland vegetation will be excavated or filled. (3) Excavation will not exceed a depth of three feet below the elevation of normal water. (4) All excavated materials will be confined above MHW and landward of regularly or irregularly flooded marsh, behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. (5) All spoils must be adequately stabilized within 30 working days of placement. (6) All basin and/or ditch slopes must be left at an angle which may be provided with a vegetative cover (or other) and stabilized within 30 working days of completion. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1988 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Project summary A Zican.t proposes to ex Pamlico County lots located near Goose Creek off. SR 1233 near Holly Point, 4 9.' Narrative descri tion The applicant is submitting this application on behalf of three lot owners in a subdivision he has developed adjacent to Goose Creek off SR 1233 near Holly Point in Pamlico County. The subdi- vision is known as Holly Point Shores Subdivision. The lots on which the development is proposed total about six acres and are about 2-3' in elevation. The shoreline is characterized by a low, eroding clan bank interrupted by extensive marsh fingers which ex- tend into the high ground. At this time, Site No. Z is bulkheaded and contains a double-wide mobiZe.home, serviced by a septic tank system. The marsh fingers contain a mixed high marsh composed of black needZerush, salt grass, sawgrass, salt meadow grass and salt reed grass. The adjacent high ground is either in a state of distur- bance, or contains pioneer grasses, myrtle, or pine. The applicant is proposing to excavate three boat basins connected onto Goose Creek. Site No. Z involves the excavation of a 16' wide by 80' long channel which will terminate in a Z6' wide by 25' Long "T" shaped basin at its uppermost end. Excavating the.channeZ will involve the disturbance of 480 sq.ft. of shallow, brackish water habitat and the disturbance of 2200 sq.ft. of adjacent high ground. Site No. 3 is similar to Site No. Z in that the basin is proposed entirely in high ground and involves a 16' wide by 95' long access channel which will terminate in a 20' long by 40' wide "T" shaped basin." Again, 480 sq.ft. of shallow water habitat will be involved in the excavation and another 1200 sq.ft. of high ground will be disturbed in constructing the access channel and basin. Site No. 2 involves an access channel/highground basin type project, but contains significant differences from Sites Z and 3. The proposed channel will be patterened to an existing mosquito control ditch which is fringed with a 50' wide border of mixed, irregularly flooded marsh. The main access channel is proposed to be ZO' wide and will follow the ditch for Z30'. At this point the channel will turn and transect the fringe of marsh and will terminate upon reaching the high ground into a 24' wide by Z6' long highground basin. The excavation will involve 940 sq.ft. of shallow, bracJdsh water habi- tat, 860 sq.ft. of mixed, irregularly flooded marsh, and 384 sq.ft. of highground area. For all three projects sp?iZ is proposed to be placed directly into trucks and transported discreet locations on the site and in some cases disposed of on Holly Point Road. 10. Anticipated impacts .Constructing all three of these boat basins will involve the'dis- turbance of 3,904 sq.ft. of highground area, Z,900 sq.ft. of shaZ low, brackish water area, and 860 sq.ft. of high marsh composed of black needZerush, salt grass, sawgrass, salt meadow grass and salt reed-grass. Adjacent waters support commercial fisheriy popu- Zations of shrimp, blue crabs; spot, broaker, trouEand various ft other finfish. Coastal wetlands perform vaZuabZe 2 foraquatichand estuarine system, providing a food terrestriaZ wiZdZife, and water quality services to the adjacent wa- ters. Mr. Sadler is acting as agent for three separate landowners to whom he has recently sold lots. Letters certifying this fact are attached with the application. The project site is located at the waterward end of Holly Point Road which intersects with S.R. 1233 near Fulford Point on Goose Creek in Pamlico County. Site one calls for an eighty foot access channel from 30' waterward of MNTL into Goose Creek to 50' landward of the MWL. The width of this excavation is to be 16'. This channel will end in a "T" shaped boat basin 25' long and 16' wide. The excavations for the entire project is to a proposed 3' depth below M6'L. All spoil is to be trucked away to a high ground disposal site. There is no marsh grass involved in the site one proposal. The site two proposal involves deepening an existing mosquito ditch from Goose Creek for 100' landward, then extending some 50' towards Holly Point Road where a 24' x 16' basin will end excavations. In addition, the dragline will extend its boom to include a 30' portion into Goose Creek, where there is a 3' water depth. (This will be necessary for sites one and three as well.) Black needlerush marsh flanks both sides of the access channel on site two, thereby necessitating the need for mats along this portion of the project. The basin area (24' x 16') is the only part that does not at present contain marsh. Site three involves a 95' x basin. Narrative description The applicant is submitting this application on behalf of three Lot owners in a subdivision he has developed adjacent to Goose Creek off SR 2233 near Holly Point in Pamlico County. The subdi- vision is known as Holly. Point Shores'Subd'ivision. The lots on which the development is proposed total about six acres and are about 2-3' in elevation. The shoreline is characterized by a low, eroding clay bank interrupted by extensive marsh fingers which ex- tend into the high ground. At this time, Site No. Z is buZkheaded 'SfF and contains a doubZe-wide mobile home,.serviced by a septic tank 1 system. The. marsh fingers contain a mixed high marsh composed of black needZerush, salt grass, sawgrass, salt meadow grass and salt reed grass. The adjacent high ground is either in a state of distur- bance, or contains pioneer grass"es, myrtle, or pine. The applicant is proposing to excavate three boat basins connected onto Goose Creek. Site No. Z involves the excavation of a Z6' wide by 80' tong channel which will terminate in a Z6' wide by 25' tong "T" shaped.basin at its uppermost end. Excavating the channel will involve the disturbance of 480 sq.ft. of shallow, brackish water habitat and the disturbance of 2200 sq.ft. of adjacent high ground. Site No. 3 is similar to Site No. Z in that the basin is proposed entirely in high ground and involves a 16' wide by 95' long access channel which wilt terminate in a 20' long by 40' wide 'ITn shaped basin. Again, 480 sq.ft. of shallow water habitat will be involved in the excavation and another 2200 sq.ft. of high ground wilt be disturbed in constructing the access channel and basin. Site No. 2 involves an access channeZ/highground basin type project, but contains significant differences from Sites Z and 3. The proposed channel wilt be patterened to an existing mosquito control ditch which is fringed with a 50' wide border of mixed, irregularly flooded marsh. The main access channel is proposed'to be to' wide and wilt follow the ditch for Z30'. At this point the channel will turn and transect the fringe of marsh and wilt terminate upon reaching the high ground into a 24' wide by Z6' long highground basin. The excavation wilt involve 940 sq.ft. of shallow, bracldsh water habi- tat, 860 sq.ft. of mixed, irregularly flooded marsh, and 3,84 sq.ft. The basin area (24' x 16') is the only part that does not at present contain marsh. Site three involves a 95' x 16' access channel abating in a 40' x 20' "T" boat basin. Like the others, an extension of 30' into Goose Creek will be necessary to attain a 3' water depth.
