A copy of the NOV is attached to this response as "Attac6ment A". According to the instructions of the NOV this response was to include explanation on the following three areas: 1) All sediment and erosion control measures will be inspected within 24 hours of receipt of this letter, and accurate notes regarding these inspections will be recorded in the Sediment and Erosion Control Log. All needed maintenance will be performed within 3 working days of the required inspection. Photo documentation of ineasures will be taken as part of the inspection, and post maintenance, and be included in a report to be included in the required response and mailed to the address below of the conditions and actions taken. 2) An explanation as to why the form struchue for the flowable fill failed, and as to how this wil] be prevented in the future. 3) The stream relocation final stabilization (the replacement of the inappropriate matting and the placement of the stones necessary to maintain a stable channel) work shall be implemented within 15 days of the receipt of this letter, with all work completed within 30 days of receipt of this letter. Photo documentation shall be included in the response requested, along with an explanation as to why it has taken so long to complete this work. Kevin Barnett and Mr. David McHenry visited the project in Clay • County. Mr. McHenry asked for us to perform maintenance on the erosion control measures located in the area of High Quality Waters. I assured Mr. McHenry that we address his area of concern that day. On the afternoon of Apri16, 2018, �Tatson Contracting employees cleaned the measures in these locations. These measures had not been cleaned in the previous inspection because additional devices (coir wattles) had been added behind the stone outlets to prevent silt from leaving the project. The remainder of the project was inspected and maintenance performed where needed. On April 13, 2018, Mr. l�eid �1Vhitehead conducted an inspection of the project and provided a list of areas for which he felt additional work should be performed. The following is the list provided by the RK&K inspector: 1).remove silt fence at 220+00 RT. To end of project. 2).added wide wattles, suggested using 2-3 together. 3).add matting to each side of new driveways. 4).install silt fence 221+-50 LT. To end of project and add outlet protection. 5).from 216+-50 RT. To 220+-50 install slop drains. 6).clean out wattle at 224+-00 RT. 7) Fix skimmer at waste AREAR. `� �� Since April 13�' was on a Friday and the forecast was showing rain on Sunday April 15�`, J �Tatson Contracting worked on Saturday, April 14th to insure all the erosion measures were in place prior to the rain event on Sunday. The above seven items were all , completed on April 14�'. After the rain event on Sunday, I inspected the project and _ i directed our employees to perform some additional mulching on April 16�'. I'hoto I�ocumentation is shown on "A�t���n�a��� �" �e�g�ons� #�) On the project ai station 192+25 there is an e�sting 24" metal pipe under the highway that was abandoned with the new storm drainage system. The pipe came to an existing drop inlet that was on the left shoulder of the road where another 24" pipe ran parrallel to US 64 going west to an existing buried junction box that is approximatley 15' deep. From the buried junction box a 30" metal pipe carries runoff to the headwater of �. Thompson Creek. On the right shoulder of US 64 an earth plug was installed to keep flowable fill from entering the drainage system that goes to Thompson Creek. On the left shoulder of US 64 a 3/4" Plywood form was inserted and braced over the 24" discharge pipe that ran parrallel to US 64 to keep the flowable fill in the only the pipe that was running under US 64. The existing structure was 8' deep and groundwater is present within four feet of excavation. Therefore we chose not to excavate and install an earth plug and used the plywood forin. The pour was one vertical foot from complete when the plywood form began to fail. Regardless of the structure depth, presence of water, of other variables we will require that excavation of any possible discharge pipes and an earth (Clay) plug be installed to prevent the loss of flowable fill operations. The discharge of the flowable fill, was removed from the headwaters Thompson Creek and the outlet of the 30" metal culvert that discharges into Thompson Creek. iS��po�a�e #�) On April 1�, 2018 the stream relocation received final stabilization as required by the permit. The shoulder excavation from stations 192+00 thru stations 210+00 was performed during the last week of November and the first week of I�ecember. I�uring this work it was noticed that the contract documentation for the stations for the stream relocation did not match the conditions in the field. The stations for cross vanes and coir fiber mat were in an area with little to no water. Water was present in the ditchline in stations below the area indicated in the contract documents. During the shoulder excavation, I was present and instructed our employees to dewater the area, grade the shoulder, install coconut matting in the ditch with coir wattles every +/-25 linear foot to prevent sediment from entering the drainage structure after the water was returned to the channel. After the matting and wattles were installed I say Mr. I�avid 1VlcHenry and Mr. Kevin Barnett iraveling thru the project. I asked them to come and look at the channel to discuss the locations of the rock cross vanes since the area of flowing water did not match the contract documents. We discussed installing the cross vanes every 20 LF in the area where there was flowing water and then replacing the coconut matting with the coir fiber mat. I told them I would call Mr. McHenry when we were going to install the cross vanes and replace the coir matting so he could come by and witness the installation of the cross vanes. Shortly after this time the weather conditions were not satisfactory to be working on the project. Snow, freezing rain, etc. since the stream was stable and no sediment was leaving the project I planned to install the cross vanes and coir matting when we returned � to the project in Spring. Due to the altitude, west facing slope, the location being in a double cut that received no sunlight during the winter months we did not return unto the project until the first of Spring to continue construction. In late March I met with Mr. McHenry and Mr. Barnett on another project and informed them that we were about to return to the Clay County project to complete the cross vanes and replace the matting. I did not since any issue from them that the work had not been completed during our conversation. We returned on the first week of April and was scheduled to begin the cross vanes the week of the spill of flowable fill. Due to the spill of flowable fill I halted all work with regard to the streams until Mr. McHenry and Mr. Barnett could complete their report on the mishap with the flowable fill. That is the reason for the delay in the channel work. When the channel work was started on April 18�' an inspector from Mr. McHenry's office was present to assist. He had instructed the operator to install the cross vanes as shown on the plan that was provided with the contract documents. The contract documents had the cross vanes drawn backwards. When I arrived on the project I called his attention to the matter, we looked ai the drawings, and he advised to continue installing as per plan. He instnxcted us to remove and reconstruct some the vanes that had been installed and continue cross vanes that was beyond the 3001f as shown on the contract documents to a location where the flowable water appeared to stop. By 5:30 '� pm on April 18�' the cross vanes were completed and the coir fiber matting had been � installed. Uncured concrete came into contact due to a form sagging and the downstream receiving water not being separated from a possible discharge. 2. The onsite sediment and erosion control maintenance worild occur 8�at afternoon, even though the inspection log indicated that no rain had fallen since the last inspection and that no maintenance was needed onsite. 3. The onsite stream relocation has been in a temporary state (staked coir logs and an unapproved matting material) since last fall. The contractor had been contacted by DOT and was told repeatedly ihat tha replacemen# of matting and placement of rock weirs would occur soon.
