R ' Reference your application for a Department of the Army
permit to construct marina facilities on the Trent River in New
Bern, Craven County, North Carolina.
Your proposal has been reviewed and found to be consistent
with the provisions and objectives of general permit No. SAWC080-
N-000-0291. Therefore, you may commence construction activity in
strict accordance with applicable State authorization and the
Pegram Associates Plan, "New Bern Waterfront Plaza," dated
February 20, 1985. Failure to comply with the State authorization
or conditions of the general permit could result in a violation of
Federal law.
If any change in your work is required because of unforeseen
or altered conditions or for any other reason, plans revised to
show the change must be sent promptly to this office and the N. C.
Division of Coastal Management prior to performing any such change
or alteration. Such action is necessary as revised plans must be
reviewed and the authorization modified.

This permit, issued on 5--' Z/' vs , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
Marina Construction and Operation
(1) The construction of all docks and piers must comply with the attached plat.
(2) This permit does not authorize any interference with the adjacent Federal
channel.
(3) If the display of lights and signals on the authorized structures is not
otherwise provided for by law, such lights and signals as may be prescribed
by the United States Coast Guard will be installed and maintained by, and
at the expense of, the permittee.
(4) No attempt will be made by the permittee to prevent the full and free use
by the public of all navigable waters at or adjacent to the authorized
structures.
(5) Prior to occupancy of any slips authorized under this permit, the permittee
will permanently equip the "marina with a pumpout facility to service boats
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31, 1988
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

ADDITIONAL CONDITIONS
with holding tanks.
(6) Prior to marina occupancy, the permittee must construct restrooms at the
marina and operate same in compliance with standards and guidelines of
the Division of Health Services and/or the City of New Bern.
(7) Trash receptacles sufficient in number and location to provide easy access
and capacity will be installed at the marina prior to occupancy.
(8) A locked head policy must be posted and enforced at the marina.
NOTE: The permittee will recognize the possibility that the authorized structure
may be subject to damage by wave wash from passing vessels. The issuance
of this permit does not relieve the permittee from taking all proper
steps to ensure the integrity of the authorized structure and the safety
of boats moored thereto from damage by wave wash. The permittee will
not hold the DCM or the United States liable for any such damage.
NOTE: The permittee is encouraged to consult with the N. C. Wildlife Resources
Commission concerning the posting and enforcement of "No Wake" operation
to prevent damage to moored vessels and to promote general boat safety.
The Commission must pass rules for such signs in public waters.
NOTE: The permittee is reminded that presently the Highway 17 swing bridge
is opened on a limited schedule. , The increase in boating activity at
the marina will cause greater demands on that schedule with subsequent
New Bern area traffic back-up and/or departure scheduling by marina
patrons.
Erosion Control and Stormwater Management
(1) The stormwater retention ponds and associated grading will be designed
so as to settle the first inch of rainfall for each rain event.
(2) All fill material must be provided with measures to adequately restrain
sediment from leaving the bounds of active construction.
(3) All fill slopes (or cut slopes) must be adequately stabilized within 30
working days.
NOTE: Since more than one contiguous acre will be affected by the activities
of this project, an erosion/sedimentation control plan must be filed.
The plan must contain all temporary and permanent measures to be utilized
and should be sent for review and approval to: Division of Land Resources,
Land Quality Section, N. C. Dept. of Natural Resources and Community
Development, P. 0. Box 1507, Washington, NC 27889.
NOTE: A Section 401 Water Quality Certification is not required for this project.
NOTE: The edges of the retention ponds should be kept free of vegetation to
prevent mosquito breeding. Straight edged ponds are easier to maintain
and to treat if mosquito breeding does occur. The applicant should
contact Nolan H. Newton, Head, Vector Control Branch, Environmental
Health Section, Division of Health Services, P. 0. Box 2091, Raleigh,
N. C., 919/733-6407, regarding applicable mosquito control measures.

General Construction
10 OT The first floor elevation of all habitable structures, as well as their
structural design, must comply with the federal flood insurance program
requirements as implemented by the City of New Bern.
(2) Any deviation in the condominium development or hotel arrangement with
reference to the plan view size or location must be re-evaluated by the
Division of Coastal Management and may require a modification of this permit.
NOTE: Plans and specifications for the water system portion of this project
must be approved by the Engineering Planning Branch, Division of Health
Services. For information concerning the approval process, the applicant
should contact F. K. Yarborough, Head, Engineering Planning Branch,
Environmental Health Section, Division of Health Services, P. 0. Box
2091, Raleigh, NC 919/733-2460.
Historic and Archaeoloqical Resources
(1) The permittee must comply with the "Memorandum of Agreement" between the
State Historic Preservation Officer (Division of Archives and History in
consultation with the DCM), the Advisory Council on Historic Preservation
and the City of New Bern concerning archaeological and architectural review
of the housing units, parking lots and other terrestrial support facilities.
(2) Should the permittee encounter cultural resources during the accomplishment
of any work associated with this permit, he will immediately cease work
and notify the Division of Coastal Management and the Division of Archives
and History.

On January 27, 1981, we issued general permit No. SAWC080-N-
000-0291 (enclosed), which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received February 1, 1985, for a
Department of the Army permit to construct marina facilities on
the Trent River in New Bern, Craven County, North Carolina,
indicates it to be a candidate for Federal authorization under
this general permit. Accordingly, the administrative processing
of your application will be accomplished by the North Carolina
Division of Coastal Management. Comments from Federal review
agencies will be furnished to the State.
If your application must be withdrawn from this general
permit process for any reason, you will be written and informed of
its further management. If there are no unresolved differences of
State-Federal positions or policy, the final action taken on your
application by the State will result in your receiving written
notice from us that your application has been successfully
processed under our general permit. Only after receiving such
confirmation should you begin work.

Dear Jim:
I have been requested by Bill Moore, Division of Environmental Management, NRCD
Washington Field Office, to provide additional information concerning the operation of the
proposed marina for the above referenced project.
A contract has been awarded to John S. Clark Construction Company for the
construction of a Sheraton Hotel, a marina, retail space, which includes a dock masters office
complete with restrooms and showers, and a convention center.
The marina will be constructed in two phases with the first phase including pump out
facilities, fuel dock and 150 boat slips. The marina will be staffed by an experienced dock
master with support staff. All boats, sail or motor, will be required by the dockmaster to use
our pump out facility or the on shore restrooms, which will be provided. Appropriate signage
will be provided which will state these rules. In addition, upon registration written rules will
be supplied to the registrar.
Boat owners who allow open dumping of their heads will be requested to correct the
situation and comply with marina rules which will prohibit such actions. Further violations
will result in expulsion of the vessel from the marina.
Our partnership is making an investment in this facility of many millions of dollars. Our
objective is to develop a first class facility. This is essential if this project is .to be
successful. We cannot allow a situation which would jeopardize the health, safety or welfare
of the public to exist.
If you need additional information contact me immediately so that our Coastal Area
Management Act permit will not be delayed. Thank you for you assistance.

Reference the application of Trent Development Associates,
represented by Mr. Tom Webb, for a Department of the Army permit
to construct marina facilities on the Trent River in New Bern,
Craven County, North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. This permit does not authorize any interference with the
adjacent Federal channel. The permittee will not be entitled
to compensation for damage or injury to the structures or work
authorized herein which may be caused by or result from existing
or future operations undertaken by the United States in the public
interest.
b. No attempt will be made by the permittee to prevent the
full and free use by the public of all navigable waters at or
adjacent to the authorized structures.
c. If the display of lights and signals on the authorized
structures is not otherwise provided for by law, such lights and

Project summary The applicant proposes to develop a Sheraton Hotel, coMner
space, a convention center, condcminium.complex and a 340 slip open water marina on
the Trent River in downtown New Bern.

9. ' Narrative 'description
This 12-acre project site is located on the Trent River waterfront in
downtown New Bern, Craven County. The property is currently owned by
the City of New Bern and contains.the circle of flags in bicentennial
park. The entire shoreline, some 1980 lin.ft. is already bulkheaded
.from the old highway 70 bridge on the east side to the railroad tres-
tle on the.west side of the property.*
As presented in the application package, Trent Development Associates
is in the process of purchasing the site for a coordinated redevelop-
ment project involving monies from the U. S. Dept. of Housing & Urban.
Development action grant program.
As proposed,.an open water marina is planned for the Trent River. The
outer boundary of the marina will encompass about 8.9 acres of open wa-
ter area., The seven primary docks and piers will support approximately
314 to 340 boat slips capable of mooring 30-55' sail boats. The pro-
posed piers will vary in length from 100' long to 650' long and will
be about 13' wide.
The project plans call for no dredging or filling in the Trent River
and all of the piers will be floating.type structures. secured to the
existing bulkhead and anchored by strategically placed mooring.pil
ings. The work plat drawings show that all of the proposed docks and
piers will be set back at least 90' from the near edge of the existing
federal channel in the Trent Rivera The aapplicant also plans to pro-
vide sanitary sewage pumpout stations anda land based fuel center to ser-
vice the proposed marina. .
The highground development includes the construction of a 4-story Shera-
ton hotel on 8.5 acres of land nearest the railroad trestle. In and
around the hotel there will be commercial shops of various types, a
convention center and -a large parking lot. Nearest the existing bulk-
head the applicant has designed a public walkway, or pedestrian corri-
dor, that incorporates a lot of open area and green space. The appli-
cant.has calculated that 70% of the total CAMA AEC will be retained as
permeable surfaces, and that only 30% of the area will be rendered im-
pervious by means of concrete and asphalt.
Towards the east side of the waterfront property on approximately four
acres of land the applicant proposes to develop a 100-unit to
condominium complex. Imported fill material will raise the overall
elevation of this area to conform with the federal flood insurance, re-
quirement for these residential type structures.
At least seven retention ponds have been designed into the applicant's
stormwater management'plan.` These retention ponds will receive rain-
water from those impervious surface areas throughout the development,
particularly during times of heavy rain.
10. Anticipated impacts
The open water marina is located in SB waters of the state and'it should
be-noted that the City of. New Bern maintains a public swim beach just
approximately 2,0001 upstream on the Trent River at Lawson Creek Park.
Theee is, therefore, a chance (at least occasionally) for water quality
to become a problem at the marina. At the same time, it has been noted
that the marina will provide adequate pumpout services.
The highground development appears to.be properly designed with ade-
quate consideration for handling stormwater runoff and permeable sur-
face areas. The City of-New Bern will supply the municipal services
of water and sewer. It should also be noted that this project is con-
sistent with the overall intent of New Bern to redevelop the downtown
waterfront area which extends to Union Point and up to the Holiday Inn
propertie's.
CAMA REVIEW
The project appears to be consistent with the LUP for the City of
New Bern.
