Randolph Reid APPROVAL of 401 Water Quality Certification with Additional Conditions and Neuse River Buffer Rules Dear Mr. Reid: You have our approval, in accordance with the attached conditions, to construct road crossings, place fill material in wetlands and install underground water and sewer utilities totaling 0.4623 acre of wetlands and waters and 141 feet of unnamed tributaries to Northeast Creek, to construct the Whitehall Subdivision in Granville County, as you described in your application received by the Division of Water Quality on October 18. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Numbers 3101, 3102, 3103 and 3108. This Certification allows you to use Nationwide Permit Numbers 12, 13, 14 and 26 when issued by the U.S. Army Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. _ This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certifications and the conditions listed below. 1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas within 50 feet of all streams and ponds. Potential buyers of these lots shall be required to notify the state of any requested future wetland or water impacts. Proposed impacts to wetlands and waters will total 0.4623 acres of wetlands and Waters of the US (NW12, 13, 14 & 26) and 141 feet of stream channel (NW 12, 13 & 14). Construction of the subdivision will comply with all of the general conditions stated within Nationwide Permits 12, 13, 14 & 26. S&EC, Inc. does not believe that wetland mitigation will be required for this site since the total permanent impacts under Nationwide Permits 14 & 26 equal 0.4512 acres (i.e., less than 1 acre) and the total linear feet of impacts to streams equal 71 feet. The impacted stream channels have not be evaluated for "importance to significant aquatic function". Hfor some reason wetland mitigation is required, our client proposes payment into the North Carolina Wetland Restoration Fund. S&EC, Inc. does not believe that buffer mitigation will be required for this.project since the Neuse River Buffer impacts caused by the one road crossing and two sanitary sewer crossings equal 111 if of stream channel and buffer. If for some reason buffer mitigation is required, our clientproposespayment into the Riparian Buffer Restoration Fund The Neuse River Buffers indicated on the attached site plan were evaluated and approved by Mr. Steve Mitchell of the DWQ Raleigh Regional Office on 8/12/99 (NBRRO 99-202). State reasons why it is believed that this activity must be carried out in wetlands (include any measures taken to minimize wetland impacts): Impacts to streams were limited to maximum extent practicable by crossing as close to perpendicular as possible. Wetland impacts are required for lot fills and road crossings. Impacts to buffers have been limited to a single road crossing and two sanitary sewer crossings. These crossings will be done at perpendicular angles. The road crossing will only impact 71 If of channel and buffer. The sanitary sewer crossings will only impact 201f of channel and buffer each. The sanitary sewer will need to impact a portion of Zone 2 of the buffer when running parallel to the stream, but will not impact Zone 1 except for the perpendicular crossings. 14. You are required to contact the U.S. Fish and Wildlife Service (USFWS) and/or National Marine Fisheries Service (NMFS) (see agency addresses sheet) regarding the presence of any federally listed or proposed for listing endangered or threatened species or critical habitat in the permit area that may be affected by the proposed project.
