Sullins Dee Freeman Governor Director Secretary May 7, 2009 DWQ Project No. 06-1302 Wake County CERTIFIED MAIL: RETURN RECEIPT REQUESTED Mr. Dan Gottlieb North Carolina Museum of Art 2110 Blue Ridge Road Raleigh, North Carolina 27607 Subject Property: North Carolina Museum of Art - Museum Expansion Project House Creek [030402, 27-33-13, C, NSW] APPROVAL OF MODIFIED STORMWATER MANAGEMENT PLAN Dear Mr. Gottlieb: On September 15, 2008, the Division of Water Quality (DWQ) issued a 401 Water Quality Certification to impact 0.8 acre of ope water (pond) in order to construct the North Carolina Museum of Art - Museum Expansion Project. Condition number 6 of the General Certification required the implementation of the approved stormwater management plan for this project. On May 4, 2009, the DWQ received a revised stormwater management plan, dated April 23, 2009, submitted by the consulting engineer Mr. Stephen Blake of Artifex ED, Inc. This revised stormwater management plan has been reviewed and satisfies the stormwater management requirements of the 401 Water Quality Certification. The structural stormwater practices as approved by DWQ as well as drainage patterns must be maintained in perpetuity. No changes to the structural stormwater practices shall be made without written authorization from the DWQ. Stormwater easements shall be recorded for a distance of at least 10 feet on each side of all storm water conveyances on all lots containing these structures including future access for maintenance. The stormwater easements shall allow for the ability to maintain the structures, perform corrective actions as described above and shall provide protection of the structures from potential alternations by future property owners. All operation and maintenance activities shall be followed as stipulated in the signed and notarized Operation and Maintenance Agreement. This letter completes the review of the DWQ under Section 401 of the Clean Water Act.
