Burdette Land Consulting, Inc. (BLC) requests a review of the buffer and intermittent/perennial
stream determinations for Features H, Z, and Z1 located on the subject site, which was
completed on December 12, 2008 and February 12, 2009 by Ms. Lauren Witherspoon of the
Raleigh Regional Office of the NC Division of Water Quality. The site is located on the
northeast side of US Highway 70 approximately 4200 feet southeast of Leesville Road's
intersection with US Highway 70 southeast of Durham, Durham and Wake Counties, North
Carolina.
Features H, Z, and Z1 involve discontinuous sections of channel located upstream of intermittent
streams. BLC believes these sections may be ephemeral due to the absence of a connection and
hydric soils except in pools. We also believe that the upper section of stream channel H above
flag #751 is intermittent rather than a perennial stream channel. The attached Surface Waters
and Wetlands Evaluation Map provided as Figure 3 depicts these features. The field verification
of these features was conducted during a particularly wet period. Therefore, we request a review
of this determination.
