Therefore, you may commence construction activity in strict accordance with applicable State authorization and the enclosed plan. W. Wanchese Landing Co., P. 0. Box 125, Manteo, NC 27954 Permit Number 24-85 authorizing development in Dare County at Croatan Sound (at Owens Canal ) _ as requested in the permittee's application dated 10/16/84 including attached plats, 2, dated modified 12/18/84. This permit, issued on a??? is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) Excavation in the Owens Canal section of the project must be completed by March 31 in order to protect shrimp resources using the area beginning in early spring. (2) Excavation within Owens Canal will not exceed a depth of ten (10) feet mean low water (MLW). (3) The plug between the basin and Owens Canal will remain in place for a 24-hour period after completion of the excavation to prevent unnecessary siltation entering into the adjacent water body. (4) All excavated materials will be confined above mean high water and landward or regularly, or irregularly, flooded marsh behind adequate dikes or other retaining structures to prevent spill-over of solids into any marsh or surrounding waters. (5) The disposal area effluent will be contained by pipe, trough or similar device to a point at or below the mean low water level to prevent gully erosion and unnecessary siltation. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1988 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Wanchese Landing Company ADDITIONAL CONDITIONS Permit #24-85 Page 2 of 2 (6) The terminal end of the pipeline will be positioned at or greater than fifty (50) feet from any part of the dike and a maximum distance from spillways to allow settlement of suspended solids. (7) A water control structure will be installed at the intake end of the effluent pipe to assure compliance with water quality standards. (8) The diked disposal area will be constructed a sufficient distance from the mean high water level or any marsh to eliminate the possibility of dike erosion into or upon any marsh and/or surrounding waters. (9) The spoil area will be properly graded and provided a ground cover sufficient to restrain erosion within thirty (30) days of project completion. (10) Outer slopes of the dike disposal area must be provided a ground cover sufficient to restrain erosion within 30 working days of placement. (11) The activity must be conducted in such a manner as to prevent significant increases in turbidity outside the area of construction or construction-related discharge. NOTE: The proposed project is certified under General Water Quality Certification No. 1273 isued on November 10, 1978, for discharges of liquid effluent from diked upland disposal areas. NOTE: This project has a strong potential for producing a mosquito breeding habitat on the spoil island. Measures such as a sand cap on the spoil could be used to prevent this problem. Project summary The applicant proposes to open and widen an existing canal and dredge Owens Canal to -12 feet mean low water to develop an off-loading site for barges in Wanchese. S. W. WANCHESE LANDING COMPANY SITE DESCRIPTION The applicant's property is approximately six acres adjacent to Owens Canal in southwest Wanchese. The area was probably Juncus marsh which.was filled to 3- to 4-feet.in elevation years ago when the existing basin was excavated. The basin is currently connected to Croatan Sound by Nannies Creek and another small mosquito ditch. Two buildings are existing on the site which has been used as a commercial facility recently. The lot is vegetated by a variety of small shrubs and weeds except for two areas. At the north end of the existing basin is a band of Black Needlerush approximately 50 feet wide which sepa- rates the 12-foot-deep basin from Owens Canal. Also, a small area of isolated Typha sup. has developed in a low area within the designated spoil disposal area. The applicant proposes to widen the basin to 80 feet by 12 feet deep utilizing a dragline to excavate the high ground. A hydraulic dredge will be used to deepen Owens Canal to -12 feet mean low water all the way out to marker number 4 where it will connect with -12-foot water. All spoils will be placed on high ground within the diked disposal area with the effluent returning to the existing basin. When this work is completed, the applicant proposes to excavate the fringing Black Needlerush marsh in a 'Y' orientation to connect the basin with Owens Canal. The 'Y'-shaped connection will allow maneuverability for the barges. ANTICIPATED IMPACTS Impacts associated with widening the basin will be minimized by the plug remaining between the basin and Owens Canal. Some short-term turbidities can be expected from this activity, as well as the mainte- nance dredging of Owens Canal. Approximately 1,250 square feet of Juncus roemerianus will be lost due to the excavation which will con- nect the basin with Owens' Canal. Because the disposal area is adequate to handle the spoil, the effluent will return to the basin which will remained plugged. It is not anticipated that the proposal will signifi- cantly impact estuarine resources. LAND USE PLAN REVIEW The project site is classified as transition (high ground) and conservation (marsh and open water) in the 1982 Dare County Land Use Plan. Wanchese Seafood Company Dear Colonel Hanson: This is in response to the recent subject permit application that proposes the deepening, widening and opening of an existing basin to the Owens Canal, and the dredging of the Owens Canal to -12 ft. M.L.W. The project site is located on the Croatan Sound on the Owens Canal, in S.W. Wanchese, Dare Co., North Carolina. The purpose of the proposed project is to develop and off-loading site for commencial barges. The existing basin is presently connected to Croatan Sound by Nannies Creek and another small mosquito ditch. At the north end of the basin is a band of black needlerush (Juncus romerianus) approximately 50 feet wide which seperates the 12 foot deep basin from Owens Canal. The applicant purposes to widen the basin to 80 feet by -12 feet deep M.L.W. out to channel mark number 4. All spoil material will be placed within a diked upland disposal site. When this aspect of the project is completed, the applicant proposes to excavate the fringing black needlerush marsh in a "Y" con- figuration to connect the basin with Owens Canal. As a result of the Owens Canal dredging, about 19,200 sq.ft. of degraded canal bottom will be removed. The wideing and opening of the existing will eliminate approximately 1,250 sq. ft. of black needlerush marsh. Black needlerush marshes perform valuable functions to the estuarine system by providing a food source and habitat for wildlife species, and water quality services to the Croaton Sound. The destruction of these valuable,biological communities should always be avoided. `.11 Wrlivl -2- Consequently, we recommend the applicant relocate his proposed opening and wideing of the existing basin to avoid the destruction of the black needlerush marsh. Wanchese Landing Company proposes to connect and widen an existing canal and dredge Owens Canal for the construction of a barge off-loading facility near Wanchese, Dare County, North Carolina. Based on a previous on-site inspection of the project area, we have determined that this project could be detrimental to fishery resources due to the loss of a small but important area of marsh and the degradation of water quality as a result of excessive depth in the canal. Wetlands in the area proposed for excavation provide nutrients, habitat, and water quality maintenance functions that are essential for the continued production of fishery resources. Excessive canal depth in relation to adjacent water depths can result in water quality degradation. The proposed -12 ft. mean low water (MLWJ appears to be excessive since the controlling depth in Owens Canal is shown as -9 ft. MLW on the project plans. In view of the above, we recommend-that this permit not be issued unless the following conditions are incorporated: 9. The connection with Owens Canal shall be realigned to avoid wetlands. 2.
