This permit, issued on is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) All excavated materials will be confined above mean high water and landward
of regularly or irregularly flooded marsh behind adequate dikes or other
retaining structures to prevent spillover of solids into any marsh or-surroun-
ding waters.
(2) The disturbed areas will be properly graded and provided a ground cover
sufficient to restrain erosion within 30 working days of project completion.
NOTE: Further development on the permittee's property may require a modification
to this permit.
This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31, 1988
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

The following comments are offered after review of the project to
determine impacts to water quality:
1. The project will not require 401 certification.
2. It is anticipated that fecal coliform violations presently
exist within the residential canal network and the proposed
project-is expected to increase fecal coliform counts within the
canal.

8. Project summary Applicant proposes to excavate a small boat basin adjacent
to a man-made canal off Westmouth Bay at Blk. 4, Sec. 2, Lot 3, Oak
Hammock Subdiv., Harkers Isl., Carteret County

9. Narrative description
The applicant's property is a half acre tract located adjacent to
a man-made canal off Westmouth Bay at Block A, Section 2, Lot 3
in the Oak Hammock Subdivision on Harkers Island, Carteret County.
The property is typical of lots in the area and was formed in the
late 160s and early 170s on coastal wetlands by dredging fill ma-
terial from adjacent wetlands that now form a navigable canal..On
the property the canal forms the northern boundary with unimproved
Jennifer Drive forming the southernmost line. The tract is actually
two lots - lot 4 containing the applicant's second home structure,
and Lot 3 presently undeveloped on which the boat basin is proposed.
The property is characterized by 4' elevations vegetated primarily
by mature myrtle. Soils are sandy held in place by non-tidal salt
meadow grass. The shoreline is bulkheaded done last year under
an exemption from this office, and a gap has been left in the struc-
ture to facilitate the boat basin feature.
The applicant proposes to construct a boat basin and boat ramp irk
the area where the bulkhead is gapped. Spoil will be spread on
the adjacent high ground.
10. Anticipated impacts
Construction of the project as proposed will result in the excava-
tion of approximately 200 sq.ft. of shallow, salt water intertidal
area and the excavation of another 680 sq.ft. of adjacent high
ground. About 381 cu.yds. of spoil will be spread over the entire
lot initially covering about 2500 sq.ft. Adjacent waters of West-
mouth Bay contain spot, croaker, shrimp, blue crabs, oyster, clams,
scallops and other commercially important species. The project is
not expected, however, to have a significant adverse impact on the
marine fisheries of the area.
