(1) In order to protect juvenile fin fish populations, no excavation or filling will be permitted between February 15 and May 15 of any year without the prior approval of the Division of Coastal Management. (2) The bulkhead will not extend waterward more than six feet or average more than three feet from the normal water level at any point along its alignment. (3) All backfill material will be obtained from a highground source and confined behind the permitted bulkhead. (4) All fill material to be placed below normal water level will be confined behind the permitted bulkhead. (5) No excavated or fill material will be placed at any time in any marsh or surrounding waters outside of the alignment of the fill area indicated on the plat. (6) The activity will be conducted in such a manner as to prevent significant increases in turbidity outside the area of construction or construction-related discharge. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. . This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1988 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. SMALL II PROJECT DESCRIPTION Y The applicant's property consists of a one-acre tract of land which is located in Newbegun Landing'Subdivision on Small Drive off Newbegun Creek, Pasquotank County. The property is undeveloped. The shoreline area is sandy/clay with no vegetation and has a typically high, vertical bank with a narrow sandy beach (0-41). The depth of the water along the shore's edge is approximately .5 feet. The appli- cant proposes to construct a wooden bulkhead approximately 150 feet along Newbegun Creek. The proposed bulkhead will extend out to a maximum of 6 feet from the NWL (average of 3'). Fill material from an upland site will be obtained to fill behind the proposed bulkhead. ANTICIPATED IMPACTS The proposed project will result in the filling of about 600 square feet of bottom area below the NWL of Newbegun Creek. The fill will be' obtained from an upland site. There was no emergent or submergent wet- lands vegetation observed in the project site.
