Certification: North Carolina General Statute 143-215.6 b (i) provides that: Any person who knowingly makes any false statement, representation, or certification in any application, record, report, plan, or other document filed or required to be maintained under this Article or a rule implementing this Article; or who knowingly makes a false statement of a material fact in a rulemaking proceeding or contested case under this Article; or who falsifies, tampers with, or knowingly renders inaccurate any recording or monitoring device or method required to be operated or maintained under this Article or rules of the [Environmental Management] Commission implementing this Article shall be guilty of a Class 2 misdemeanor which may include a fine not to exceed ten thousand dollars ($10,000). 41) Signatory Requirements (per 40 CFR 122.22) All applications, reports, or information submitted to the Director shall be signed and certified. a. All notices of intent to be covered under this General Permit shall be signed as follows: (1) For a corporation: by a responsible corporate officer. For the purpose of this permit, a responsible corporate officer means: (a) a president, secretary, treasurer or vice president of the corporation in charge of a principal business function, or any other person who performs similar policy or decision making functions for the corporation, or (b) the manager of one or more manufacturing production or operating facilities employing more than 250 persons or having gross annual sales or expenditures exceeding 25 million (in second quarter 1980 dollars), if authority to sign documents has been assigned or delegated to the manager in accordance with corporate procedures. This plan has been prepared by Parker & Associates, Inc. 1. SITE PLAN A. See the attached Exhibit 1 — Color Portion of Folkstone USGS map, and Exhibit 2 — Portion of Onslow County D.O.T. Map, and Mine Site Plan. B. The Wellman Mine is a proposed sand mining operation only. Sand shall be excavated and loaded directly into trucks and hauled off site to other locations. Loading shall be performed with an excavator. Other than normal daily maintenance, all equipment service shall be performed off site. No fuels or lubricants shall be stored near or in the mining area. Excavated material is normally wet so dust shall not be a problem in mine. The haul road shall be monitored and periodically dampened utilizing a water truck when necessary to control any dust created from hauling operations. There shall be no waste generated from this operation, therefore, no disposal plan is needed. The possible pollutants to be concerned with are small amounts of fuel or hydraulic oil created by a ruptured hose or pipe on trucks or equipment. This should not be a normal occurrence but in the unlikely event that it does happen there always shall be someone on site to minimize and contain the spill before it reaches any water source. Any contaminated soils shall be removed and disposed of at a facility certified to treat soils. C. See the attached Mine Site Plan by Parker & Associates, Inc. D. Pumping shall be performed only as needed and never immediately after or during a rain event. Water shall be drawn from just below the surface (6"-12") of the water to pump the clearest water. Visual checks for clarity shall be performed each time the pump is operated. Any foam, discoloration or unusual odor shall result in immediate shut down of pump and discharge. Samples shall be collected and analyzed by a certified laboratory as required in the NPDES General Permit — NCG020000 and results shall be kept on site. Results shall also be forwarded to NC DEMLR annually as required by the General Permit. At any time sampling results exceed acceptable levels, discharging shall cease until conditions become more favorable and samples shall be taken monthly for a period of one year or as outlined in the General Permit. After such time, if levels have been consistently lower than acceptable levels, samples shall be drawn on a quarterly basis at minimum or as deemed necessary. Daily records shall be maintained on site recording times and amounts of pumping as well as recorded rainfall. 2. EROSION AND SEDIMENTATION CONTROL The site shall install and maintain all erosion control measures shown on the approved mine site plan. There shall be no gravity discharge of stormwater to the adjacent wetlands or creek; therefore, there are no special erosion and sedimentation control measures. The dewatering discharge shall pump into a rip rap lined basin, then flow through the 50' undisturbed buffer prior to flowing into the wetlands, then flow through several hundred feet of wetlands prior to reaching the creek. The facility shall be operated and maintained in compliance with the mining permit issued by the Division of Energy, Mineral and Land Resources. 3. STORMWATER MANAGEMENT PLAN A. All excavation and land disturbance shall be confined to the mine area with only one controlled discharge source (dewatering pump). Natural grade in the area prohibits stormwater run-on as all areas sheet flow to wetlands away from mining area. No discharge of stormwater (pumping) shall occur until all solids have settled and water is clear. B. An inspection of mine slopes, entrance/exit, and stormwater protection devices (BMP's) shall be conducted weekly or within 24 hours of any storm event by the mine operator or other competent person. No discharge shall take place during or immediately after a storm event. A rain gauge shall be kept on site and monitored and all rainfall recorded. A record of inspections, deficiencies and corrections shall be recorded and kept on site. C. There shall be no bulk storage of any kind on this site. SPPP - 2 4. WETLANDS MONITORING The adjacent wetlands shall be monitored annually by a Soil Scientist to determine if the mine dewatering is having a detrimental effect on the wetlands. A yearly report shall be filed and kept by the mine operator. If it is determined that the wetlands are being affected, a mitigation plan shall be developed by the Soil Scientist and presented to NC DEMLR for approval. 5. SPILL PREVENTION AND RESPONSE PLAN (SPRP) There shall be no bulk storage of any kind on site; therefore, there is no potential for spills. 6. PREVENTATIVE MAINTENANCE AND GOOD HOUSEKEEPING PROGRAM All equipment and trucks shall be kept in good working order and kept on a regular maintenance schedule. Operators shall be trained and required to inspect equipment prior to starting work each day and periodically throughout each shift. Operators shall look for fluid leaks as well as potential leaks and shall not use equipment if any problems are found. All equipment with any type of leak shall be removed from mine immediately and repaired. Equipment shall be removed from mine and washed periodically to prevent rainwater from washing contaminants from machine onto ground. All equipment shall be checked by mine operator or qualified mechanic weekly. 7. EMPLOYEE TRAINING Training for all involved in mine operation shall be required annually. This training will include safety, things to look for that could possibly contaminate water, equipment inspections, and instructions on what to do if a spill occurs. All new employees and anyone working in mine area shall be required to receive training before entering mine. Training shall be provided by mine operator. Mine operator shall stay up to date on new references and resources pertaining to mining safety and stormwater management. 8. RESPONSIBLE PARTY The Mine Operator shall be responsible for overall coordination, development and implementation of the SWPPP, and all mine and dewatering practices. He shall ensure that all requirements are met and all records are up to date. The Operator shall be also responsible for training of employees and personnel. SPPP - 3 9. PLAN AMENDMENT The SPPP shall be reviewed annually and amended as needed and all changes incorporated into training and Best Management Practices. 10. Pittman Soil Consulting performed a soil study to make certain that the Onslow County Soil Survey map was somewhat accurate. This evaluation determined that the listed soils on the soil survey were concurrent with what was identified in the field. According to the soil survey Leon, Murville, Torhunta, and Foreston soils are present in the proposed mine area. The provided topographic data survey showed ground elevations of 48-62' above sea level in the mine area. -For this evaluation we used the average of the low and high ground elevations which was calculated to be 55' above sea level -Average published seasonally high water table for each soil series( Leon 0.5' bgs, Murville 0.5' bgs, Torhunta F bgs, and Foreston 2' bgs) -Water elevation in the pit once the mining operation has concluded will be approximately 2' lower than the published seasonally high water table Using this data and the topographic map provided by Parker and Associates the following elevations were determined for water in the proposed mine per each soil series versus ground surface elevations in the adjacent wetlands. Based on these calculations the elevation of the water in the pit for the Torhunta series would be lower than the wetland elevation. Published soil survey and in situ soil data were collected and input into the Lateral Effect model to determine the appropiate setback. The model could not predict the required setback because of the small increment of difference. This would warrant a setback of 50' from the wetlands even though the setback could be less than 1 foot. The remaining soil series were found to have final water table elevations that were higher than the wetland elevations. This would suggest flow from the pit to the wetlands and the minimum setback of 50' would be adequate. The proposed setback to the mine as currently designed are 50' from the wetlands.
