Donald Pokewaldt and Douglas Twiddy for a Department of the Army permit to construct and backfill a bulkhead on Currituck Sound in Duck, Dare County, North Carolina. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. By letter of September 20, 1985 (copy enclosed), the National Marine Fisheries Service recommended denial of the application due to the proposed conversion of approximately 3700 square feet of productive shallow water habitat and wetland vegetation to fast land. A bulkhead,, constructed landward of marsh vegetation, would provide protection from erosion. We concur with this recommendation that authorization not be provided. Project description_ The applicant owns a parcel on Duck which is on the Currituck Sound. Two old buildings exist on the property, and one is presently being renovated for commercial use. The property averages 4' above NWL and slopes to the sound. The shoreline is littered with old tires, rocks and other debris which were placed in an attempt to abate er- sion. Remnants of delapidated bulkheads are scattered along the shoreline, but are beyond repair and do not function to lessen ero- sion. On April 2, 1985, the Corps of Engineers and Coastal Management staked an alignment for a general.permit bulkhead which was landward of the fringe of marsh; -This marsh is comprised on Scir us sp, S ap rtina c nosuroides, and some S artina patens and covers approximatel.y- ,520 sq.ft. The applicant is requesting a bulkhead alignment which will tie into the existing bu.lkhead to the south and average 17' waterward of the NWL along its 190' lengtho Seven condominium/retail shops are pro- posed to be built on the improved site,.all of which will be serviced by a low pressure septic system. 10. Anticipated impatcs If the development is constructed as proposed, approximately 2,700 sq.ft. of productive, shallow water habitat will be filled, and 1,520 sq.ft. of coastal wetlands will be lost. The highground development will result in greater than 30% of the estuarine shoreline AEC to be covered which would result in adverse impacts to water quality. CAMA Review - The Highround portion of the project site is classi- fied as community" in the Dare County LUP, The coastal wetlands and open waters are classified as "conservation." The project as proposed is inconsistent with the language on Page 4-3 of the LUP which states in part: "The conservation class is to provide for effective long term management of significant limited or irre- placeable areas." Under the administrative rules of our regulatory program, denial of required State authorization precludes favorable consideration of a Federal permit. Accordingly, your Department of the Army application is hereby denied, and your file has been retired. Additionally, we received unfavorable comments from the National Marine Fisheries Service (copy enclosed). Their reaction to your proposal is the result of anticipated significant adverse impacts. I have provided this Federal agency's comments to alert you to concerns in addition to those identified in the State's denial letter. While appealing the State permit is the next step in pursuing State authorization, you should be aware that Federal agency comments will be unchanged by the outcome of that appeal. Because of the Federal agency's influence on Department of the Army permit decisions, it is unlikely a Department of the Army permit would be available unless your project can be modified to lessen its impacts. Box 232-C Duck, NC 27949 Dear Mr. Pokelwaldt: This letter is in response to your request for a permit under the Coastal Area Management Act and State Dredge and Fill Law to bulkhead and fill 4,220 square feet of coastal wetlands and estuarine shoreline for the construction of condominiums and retail shops on the Currituck Sound in Duck. Processing of your application under a joint State and Federal review, including on-site investigation by cooperating agencies, is now complete. In the course of this review, four State and two Federal agencies have submitted objections or expressions of concern to the proposal. Based on this review, the Division of Coastal Management has made the following findings: 1) The project, as proposed, would result in the direct loss of 4,220 square feet of significant shallow water and wetlands habitat; 2) The proposed use of the filled area is not water dependent; 3) Impervious surfaces of the development would exceed 30% of the Areas of Environmental Concern portion of the property; 4) The project is inconsistent with the Dare County Land Use Plan, which reads in part, "Construction within the conservation classifi- cation is suitable only if development will not irretrievably alter wetlands or estuarine waters"; P.O Box 27687, Raleigh, North Carolina 27611-7687 Telephone 919-733-2293 An Equal Opportunity Affirmative Action Employer V Pokelwaldt and Twiddy Page 2 October 18, 1985 5) The project is inconsistent with the following partial listing of State Guidelines for Areas of Environmental Concern: a) 15 NCAC 7H.0205(c), Management Objectives (for coastal wetlands). This requires projects to give highest priority to the protection and management of coastal wetlands so as to safeguard and perpetuate their biological, social, economic and aesthetic values; to coordinate and establish a management system capable of conserving and utilizing coastal wetlands as a natural resource essential to the functioning of the entire estuarine system. b) 15 NCAC 7H.0206(c), Management Objective (for estuarine waters). This rule establishes, as the highest priority, the management and conservation of the important features of estuarine waters so as to safeguard and perpetuate their biological values. c) 15 NCAC 7H.0208(a)(1), General Use Standards. Uses which are not water dependent will not be permitted in coastal wetlands, estuarine waters, and public trust waters. Restaurants, resi- dences, apartments, motels, hotels, trailer parks, private roads, factories, and parking lots are examples of uses that are not water dependent. d) 15 NCAC 7H.0208(a)(2)(A). This standard states that the location., design, and need for development, as well as the construction activities involved must be consistent with the stated management objective. e) 15 NCAC 7H.0208(a)(2)(B). This standard requires that there be no suitable alternative outside of the AEC for the project and that the applicant select a combination of sites and design that will have a minimum adverse impact upon coastal marshland, and spawning and nursery areas. f) 15 NCAC 7H.0208(b)(7). Bulkheads and Shore Stabilization Measures. (A) Bulkhead alignment, for the purpose of shoreline stabili- zation, must approximate mean high water or normal water level. (B) Bulkheads shall :be constructed landward of significant marshland or marshgrass fringes. g) 15 NCAC 7H.0209(e)(2). This standard requires that not more than 30% of the AEC be covered with an impervious surface, unless through innovative design, the protection provided by the design would be equal to or exceed the protection by the 30% limitation. S. 113A-120(2), which requires found to be inconsistent with the 113A-120(8), which requires denial Guidelines for Areas of Environmental your permit application must be denied. 113-229(e)(5), which provides for permit adverse impact on estuarine resources, CAMA permit denial when the project is State Dredge and Fill Law, and G. S. of projects inconsistent with the State Concern or local land use plans. If you wish to appeal this denial, you are entitled to a quasijudicial hearing before the Coastal Resources Commission as provided by the Coastal Area Management Act. A request for a hearing must be submitted in writing within twenty days of the date you receive this letter. Ms. Robin Smith, Chief of the Coordination and Research Section at 733-2293, is available to discuss the appeal procedure with you. In lieu of a hearing, you may wish to modify your proposal. Department personnel are available to discuss alternatives with you. It is, of course, the policy of this office to assist an applicant with his project while protecting our vitally important coastal resources. It should be noted that George Wood of my staff previously staked a bulkhead alignment that would remove the objections of several of the commenting agencies. Other measures, such as reducing the impervious surfaces covered, could also result in more favorable comments. Also, you should be advised that as long as this State permit denial stands, your project must be deemed inconsistent with the North Carolina Coastal Management Program, thereby precluding issuance of Federal permits for this project. The Federal Coastal Zone Management Act of 1972 (CZMA) gives you the right to appeal this finding to the U. S. Secretary of Commerce, within 30 days of receipt of this letter. Your appeal must be based on the grounds that the proposed activity is (1) consistent with the objectives or purposes of the CZMA or (2) is necessary in the interest of national security, and thus, may be Federally approved. Project description The applicant owns a parcel on Duck which is on the Currituck Sound. Two old buildings exist on the property, and one is presently being renovated for commercial use. The property averages 4' above NWL And slopes to the sound. The shoreline is littered with old tires, rocks and other debris which were placed in an attempt to abate er- ::ion. Remnants of delapidated bulkheads are scattered along the shoreline, but are beyond repair and do not function to lessen ero- sion. On April 2, 1985, the Corps of Engineers and Coastal Management staked an alignment for a general permit bulkhead which was landward of the fringe of marsh. This marsh is comprised on Scirpus sp, Spart?ina c nosuroides, and some Spartina patens and covers approximately 20 sq. t. The applicant is requesting a bulkhead alignment which will tie into the existing bulkhead to the south and average 17' waterward of the NWL along its 190' length. Seven condominium/retail shops are pro- posed to be built on the improved site, all of which will be serviced by a low pressure septic system. 10. Anticipated impatcs If the development is constructed as proposed,'approximately 2,700 sq.ft. of productive, shallow water habitat will be filled, and 1,520 sq.ft. of coastal wetlands will be lost. The highground development will result in greater than 30% of the estuarine shoreline AEC to be covered which would result in adverse impacts to water quality. CAMA Review - The Highround portion of the project site is classi- fied as community" in the Dare County LUP, The coastal wetlands and open waters are classified as "conservation." The project as proposed is inconsistent with the language on Page 4-3 of the LUP which states in part: "The conservation class is to provide for effective long term management of significant limited or irre- placeable areas."
