Washington Regional Office SUBJECT: Regional Office Review and Recommendations Pea Island Resort 1 -Dare County A preliminary review of the proposed project indicates that: REcEI QED Grp 1,9 A11Tv cECTJnkr A 401 Water Quality Certification will not be required. A 401 Water Quality Certification will be required, and will require public notice advertisement. A-401 Water Quality Certification-will-be-required, -but should meet the conditions of the General Certification for and therefore will not require public notice. Final review and recommendations 9-18-85 A 401 Water Quality Certification will riot be required, this office has no objections to the proposed project. x It is recommended that a 401 Water Quality Certification be issued containing a turbidity limit of 25 : 50 NTU. This office has no objections to the proposed project. The proposed project appears to meet the conditions of the General Certification for: This office has no objections to the proposed project. Additional Comments: A revised stormwater management plan for the proposed development was delivered to this office on 9-17-85 by Mr. Dal Barber. The project involves the development of 415 camp sites, 3 central bath houses, sales office, tennis courts, and clubhouse, and a boat ramp. The sewage will be treated in 7 separate septic tank/nitrification systems. The project will result in approximately 27% impervious area. The design features of the stormwater management plan are as follows: 1) A peak one hour intensity rainfall of 212 inches was used in the calculations (a frequency interval of approximately once in 5 years); cc: 2) Paved areas will be graded to direct storm runoff to one of 3 retention ponds. 3) 88% of runoff from concrete pads (camp sites) was included in the calcula- tions of the detention basins. (This indicates 12% would run off to adjacent grassed areas and percolate into soil) 4) Runoff from buildings located within 30 ft. of surface waters or paved areas will be directed to retention basins. 5) Runoff from buildings set back 30 feet or more from drainage ways will be directed by sheet flow over grassed buffers. The proposed stormwater management plan adequately addresses the impacts of storm runoff to surface waters. The design features of the plan are reasonable and should protect water quality standards in adjacent SA waters. It is recommended that a 401 water quality certification be issued. Munden and Harrel Johnson WATER QUALITY September 13, 1985 ScCT10N CAMA Permit Application - Pea Island Resort, Dare County The Division of Marine Fisheries objects to the Pea Island Resort project as proposed because it is felt that the stormwater management plan is in- adequate to protect the quality of shellfish waters in the immediate vicinity of the proposed project. The Division of Marine Fisheries also feels that the proposed project contains an unacceptable amount of impervious surface within the 75 foot estuarine area of environmental concern (AEC). The waters of P-amli=co-found lying-to-the-west of--the--?reposed-lroj-ect--are-cl-mifi-ecF-as -SA and are therefore approved for the harvest of shellfish for human consumption. It is felt that the project, if developed as proposed, will result in closures of nearby shellfish waters due to increased stormwater runoff and associated increases in coliform bacteria levels. The Division of Marine Fisheries has expended little of its oyster rehabilitation effort in the immediate vicinity of the proposed project in the past because of a lack of suitable equipment. The DMF has recently received funding for construction of a shallow draft vessel and will increase its oyster rehabilitation efforts in the eastern portion of Pamlico Sound in 1986. The waters near the proposed project currently meet the Division's criteria for shellfish rehabilitation sites, and it is conceivable that a shellfish management area could be established in the vicinity in the future. Shellfish rehabilitation efforts in the area would be precluded if the waters were closed to the harvest of shellfish because of pollution. The area of Pamlico Sound adjacent to the project site is heavily utilized by commercial crab potters, as well as serving as an overwintering area for female crabs. Stormwater runoff could affect the value of this area for crabs and crabbing. In addition, the applicant should be advised of the potential for conflicts between commercial crabpot fishermen and non- commercial users associated with campground development. It appears that the three piers which.are proposed to be located in the natural slough on the north side of the property have the potential for docking more than 10 boats and meet the Division of Coastal Management's criteria for a marina. Also, the 500 feet of walkway running along the edge of the slough from the sales office to near Highway 12 and then westerly to the outermost pier has the potential for docking a large number of vessels of various sizes. The Division of Marine Fisheries is opposed to any future development of this natural slough as a marina. 2 00- .1; It is recommended that the following changes be made in the design of the proposed project in order to address Marine Fisheries concerns: (1) The stormwater management plan should be designed in accordance with the Division of Environmental Management guidelines of a 100 year storm event rather than the 5 year storm event used in the August 29, 1985 stormwater management plan submitted by the applicant. (2) Retention ponds should be located as far as possible from the SA waters of the Pamlico Sound or any outlets to these waters. In all cases the ponds should not be located within the 75 foot estuarine AEC. (3) No campsites should be located within the 75 foot estuarine AEC. (4) Impervious surface within the proposed project should be reduced by the use of turfstone or similar materials whenever possible, particularly in the low traffic areas such as the pads where the camping will occur. It is my understanding that Mr. Felton will be submitting a stormwater management plan in the near future. Project summary The applicant proposes to construct _a_ campground on 48.7 acres in Waves. PEA ISLAND RESORT SITE DESCRIPTION The applicant owns 48.7 acres near Waves, North Carolina, which extends from the Pamlico Sound across N.C. Highway 12 to the National Park Service boundary. The high ground is separated from the sound by a wide border of wetlands comprised of myrtles, cord grass, black needlerush, salt grass, salt meadow grass. These wetlands have been flagged and are represented on the blue lines. On the north side of the property, a natural slough extends from the sound to the other side of the highway. This slough is bordered by black needlerush and salt grass which has also been flagged and depicted on the plats. It is in this area that a sales office, a handicapped access ramp, an unpaved parking area to the north, and a paved parking area to the south of the sales office has been constructed under CAMA Minor Permit #85-019. The property on the ocean side of Highway 12 is typical rolling, sandy soils vegetated by myrtles and scrub pines and extends to within 300 to 350 feet of the first line of stable, natural vegetation along the ocean where it abuts the National Park Service boundary. In order to describe what is proposed by the applicant, the sheet numbers will be used to describe specifics while some general characteristics of the proposal will be described. Sheet #3 The northern section of oceanward development has an annual erosion rate of 8 feet per year for 250 feet from the northern boundary and then becomes 5 feet per year for the remainder of the oceanfront. All structures proposed are outside of the 30x set- back except for the dune crossovers. The applicant is providing a letter of permission from the National Park Service to construct these structures on their property. A well site is proposed on the border of the property with the recharge area using a portion of the Parks Service property. A pavillion is proposed which is less than 5,000 square feet and thus is constructed landward of the setback as is the proposed gazebo. This sheet also shows three bathhouses and seven drain fields to service them and the septic hookups from each of the 95 paved camping areas. Paved road access is proposed in this area. Sheet #4 This southern section of oceanfront development lies within an area having an annual erosion rate of 5 feet per year. The proposed gazebo and two well points are behind the 30X setback, but once again the well recharge areas extend into the NPS land. Four drain fields are proposed in this area with repair areas. Ninety-six paved camping areas are proposed with paved road accesses. Sheet #5 This area is landward of the proposed development depicted on Sheet #3 and adjacent to Highway 12. Four drain fields and two bath houses are to be located in PEA ISLAND RESORT Page 2 this area. Adjacent to the highway a large club house will be constructed which will separate the 64 paved compsites from the highway. Paved access, as well as the main entrance, is proposed in this area. Tennis courts, shuffleboards, and other recrea- tional activities will be provided in this area. Sheet #6 Development in this area lies landward of that proposed on Sheet #4 and south of that depicted on Sheet #5. Seventy-one paved compsites and one drain field is proposed in this area. Paved access is also proposed. Sheet #7 This plat depicts in part the portion of the proposal which has been constructed under LAMA Minor Permit 85-019. The 36-space parking lot on the north has been constructed but not paved. This request includes authorization to pave this area. The parking to the west of this parking lot is proposed for boat trailer parking and a 15-foot-wide -boat- r_amR is- dep=i cater wh ch would- result -in the fill i ng of -150- square -feet of Juncus marsh. The piers are proposed to be constructed over water in the canal except for a deck which is to be located partially over marsh and will be associated with a boat rental facility on high ground. The sales office access ramp and paved parking to the south of the canal was authorized by CAMA Minor Permit 85-019. Also proposed in this area are 22 paved camping sites which will be constructed adjacent to the wetland line depicted on the plat. A gazebo is proposed on the high ground with walkways over the marsh. One 12x30 platform is proposed to be constructed over Juncus and Spartina patens marsh. Sheet #8 This area is to the south of the area depicted on Sheet V. Proposed are 72 paved camping areas and walkways over the marsh. Two 12x30 platforms are proposed over Juncus and Spartina marsh and a gazebo is proposed adjacent to the sound over Juncus, Distichlis, and Spartina marsh. Wood Page 3 PEA ISLAND RESORT ANTICIPATED IMPACTS The applicant has redesigned the proposal to avoid the siting of camping areas in wetlands; however, walkways, platforms, and gazebos are proposed in lush coastal marsh. A 15-foot-wide boat ramp will result in the filling of 150 square feet of Juncus roemerianus. Most of the development proposed on the 48-acre trace involves the grading and paving of high ground sandy soils. Care must be taken in designing the project to minimize storm water runnoff from entering adjacent waters. The structures on the oceanfront (except for the dune crossovers) are behind the NPS land which is 300 to 350 feet from the first line of stable, natural vegetation and, therefore, beyond the 30X setback for this area. The recharge area for some well points and dune crossovers extend into property controlled by NPS. The applicant has assured me that a letter of permission to undertake development on this property will be coming from the NPS.
