Wake Forest, NC 27587 Subject: Nationwide Permit 923 NC 194 Resurfacing -Avery County, North Carolina TIP# R-5158 (No DWQ Permit Fee Required) Dear Mr. Matthews: The NC Department of Transportation is scheduled to resurface NC 194 in Avery County from US 19E to SR 1106. Minor widening will occur in a number of locations. A few paved ditches will be constructed as well. Total project length is approximately 0.91 miles. The impervious surface area will increase by approximately 0.22 acres. Please note that we are not proposing to extend the `existing fill slopes. We will however be conducting some shoulder reconstruction activities once the resurfacing is complete. Several wet pipes/culverts will be retained. We will however be replacing a few wet pipes at the following locations: Stream Impacts: Station Number Existing Structure Size ` Proposed Structure'Size Riprap, Im acts ft. An impervious sandbag dike will be constructed upstream of the existing culverts to create a Mr. Monte Matthews R-5158 (NC 194 Resurfacing, Avery) Page 2 April 30, 2009 small pool. Clean water will temporarily be pumped around the construction areas and will be discharged downstream. Any dirty water located inside of the construction areas will be pumped into a silt bag if necessary. Total dewatered area for all wet pipe replacement areas will be approximately 0.006 acres. Once the new pipes are in place, the impervious dikes will be removed and preconstruction streambed elevations will be restored. Permitted Site Coordinates - Station Latitude Lon itude 4+82 35.97175 -82.01109 21+00 35.97111 -82.00669 22+40 35.97120 -82.00639 The wet pipes in question carry different unnamed tributaries to Threemile Creek (Class: WS-IV, Trout). This project was reviewed for the presence of threatened and endangered species on April 16, 2009. This project will have no effect on any federally listed endangered plant or animal species. The State Historic compliance surveys will be conducted if requested. The project impacts are minor in nature and should not remove or degrade existing water quality uses. Pipe sizes used will be the minimum necessary to create a safe roadway. By utilizing the erosion control measures outlined in the attachments to this application, downstream water quality standards will be protected. All appropriate BMPs will be used during construction. Attached is a Preconstruction Notification Form, plan sheets with proposed erosion control measures, a marked county map, a marked topography map and photographs. By copy of this letter, it is requested that Mr. Ron Linville, Mountain Region Coordinator, with the North Carolina Wildlife Resources Commission comment directly to you concerning the 404 Nationwide Permit application with a copy sent to me.' Please note that although we are not proposing to extend the fill slopes, some of the shoulder reconstruction work will fall within the 25-foot buffer zone of Threemile Creek. As a result, we will be requesting a trout buffer variance for this activity. We would like to begin construction as soon as possible. If further information is required, please let me know.
