I have talked with the applicant, Mr. Elton Ange, and the project engineers so that we can provide some additional information to support the location of the offsite utility easement and the proposed riparian buffer impacts. First and foremost, we would like to reiterate the effort that took place to purchase the easement to connect to the existing utility easement on the west side of Cedar Creek. That was Mr. Ange's preferred utility connection for sanitary sewer for this project. That was the utility connection that was purposed within the first Pre -construction Notification application for the Clearwater Creek subdivision and the utility connection that was initially pursued. However, the owner of that parcel of land will not sell an easement to Mr. Ange even after several communication efforts. Mr. Ange has only two options for providing sanitary sewer to his property and with the utility connection to the west side being removed as an option, his only other option was to pursue an easement on the already developed land to the south. The development to south, Forest City, is an existing residential development. That development/property has an existing jurisdictional pond, existing stormwater BMP with retaining walls, and a level spreader that the engineer had to avoid when determining the location of the offsite sanitary sewer easement. Additionally, the sanitary sewer manhole connection was an existing manhole within the roadway (i.e. Hawksbill Drive/Lane Store Road) to the south. With regard to the sanitary sewer easement and it's proximity to the stormwater BMP and level spreader, the project engineer has provided the following justifications as to the location of the proposed sanitary sewer easement, in addition to the attached exhibit: The sewer line is placed next to the existing stormwater BMP that has a fill embankment on the downstream side. The sewer easement was placed safe distance away from the stormwater pond's fill slopes and existing retaining wall. The separation provides adequate safe placement for construction of the sewer main without undermining the existing slopes and retaining wall of the existing stormwater BMP. Further south, close to the existing Lane Store Road, the existing stormwater pond has a level spreader (downstream from the pond fill embankment). The level spreader and the area downstream was provided for the water quality purposes as part of the existing stormwater BMP. The proposed sewer line steers clear of this zone and that resulted in the current placement within the buffer. With the above additional information, we anticipate that this will assist you in your review of the Clearwater Creek Subdivision -Offsite Utility Riparian Buffer Authorization application.
