By letter of April 23 2008, we requested that you furnish additional information regarding
your application for Department of the Army authorization to permanently impact 3,890 linear
feet of stream channel and 0.48 acre of wetland in order to develop a residential community, two
golf courses, and associated infrastructure near Tuckasegee in Jackson County, North Carolina.
The correspondence included comments received in response to the Public Notice dated
February 9, 2007. We requested that you respond to this office within 30 days of receipt of this
letter so that we could continue to review and process your permit application.
Your authorized agent, Wetland and Natural Resource Consultants, informed us that the
additional information would be submitted to us in August of 2008. During a site visit on
December 4, 2008, we were informed by you and your consultant that the requested information
would be submitted by the end of March 2009. To date, we have not received the requested
information from you. If we do not receive the requested information within 14 days of your
receipt of this letter, we will assume that you no longer wish to pursue Federal authorization and
your application to impact waters of the U.S. will be withdrawn.
