On April 15, 2009, Mr. Alan Johnson of this office conducted a 401 Certification compliance inspection
at the subject site to determine if the project was constructed as submitted to the Division of Water Quality
(DWQ). Based on our inspection, the construction appeared to be, in general, compliant. However there were
some areas of concern:
There is concern regarding the use of riprap at the downstream end of the culvert. The stream
flow must be over the riprap, not through the riprap. Also, the original stream dimensions are to
be maintained immediately above and below the culvert installation (additional condition #4).
Based on the conversation with Mr. Mike Hamilton at this site, this doesn't appear to be the
plan. Minor adjustments appear to be required to the velocity dissipater at the down stream
end of the culvert.
There is concern of sediment entering the stream at the culvert. Given the down hill gradient
towards the culvert and lack of measures to mitigate runoff, this could lead to sediment impacts
to the stream. There are already signs of sediment deposition below the culvert.
There was a pre-existing culvert/crossing in the stream approximately 50 feet up stream of the
new culvert that is in disrepair. If the old crossing/pipes are not needed, it is requested that it be
removed.
It is requested that a written response be submitted to this office by May 30, 2009. Included with
your response, please include your NPDES storm water records for the month of April through the
