TROGDON, III SecRernav In accordance with the directives noted in your letter dated April 12, 2018, Mr. Reid Whitehead, Area Roadside Environmental Engineer and Mr. Stephen Sellers, Project Inspector conducted a thorough inspection of all sediment and erosion control measures on April 13, 2018. Attached aze photographs of the azeas that were disturbed from work which occurred that week as well as the NPDES Inspection Form detailing corrective measures that were needed. Additional measures were installed and the maintenance of existing measures was performed and completed on April 14, 2018. The Contractor notified Mr. Kevin Barnett on April 16, 2018 that the work had been completed. The wooden form structure failed due to inadequate bracing. Typically wooden forms aze not used to contain flowable fill, but rather masonry pipe plugs aze used. The Department will ensure that masonry pipe plugs are always used in the future. The initial stream relocation work commenced on November 29, 2018 and continued through December 2017. T'he stream was created approximately 20 yeazs ago when a utility company was installing buried fiber optic cable and damaged an existing subsurface drainage system that was installed in the 1970s when the highway was originally constructed. This damage caused the subsurface drainage to begin flowing in the ditchline of the highway and furthermore was not indicated on the current projecYs construction plans as being an issue. Mr. David McHenry made application for the environmental permit allowing the Department to relocate the stream to facilitate construction of the project. The stream relocation work was performed during the winter months and temporary matting was placed in an effort to stabilize the channel through the season. Our plans were to place the permanent matting, construct rock cross vanes, and plant permanent vegetation in the Spring of 2018. This permanent work is scheduled to begin on April 18, 2018 and is anticipated to be complete in less than one week. The Contractor has advised that he will be providing you with a fully detailed accounting of his work in writing within the next couple of weeks. As we discussed, we implemented corrective action to the area of High Quality Waters on April 6th, the day you were on the projed reviewing our concrete spill. Additional measures were installed in this area as requested by Mr. Whitehead the day following his inspection on April 9th. Upon receiving the NOV and the inspection by Mr. Whitehead on April 13th, Additional measures were installed and further maintenance on existing measures on April 14th prior to the rein event this weekend. We will install the rock cross vanes and coir mat to.the channel on Wednesday and Thursday this week. I will be preparing the formal response with the pictures and explanations upon completion of the cross vanes. The onsite sediment and erosion control maintenance would occur that afternoon, even though the inspection Iog indicated that no rain had fallen since the last inspection and that no maintenance was needed onsite. 3. The onsite stream relocation has been in a temporary state (staked coir logs ancl an unapproved matting material) since Iast fall. The contractor had been contacted by DOT and was told repeatedly that the replacement of matting and placement of rock weirs would occur soon. No action has been taken to close out this work. The impacts were zequested under U.S. Ar�ny Corps of Engineexs Nationwide Permit(s) 14, and the corresponding General Water Quality Certificaiions. The NCDWR issued an approval.letter allowing the unpacts on August 7, 2017, NCDWR project number 20110424 Ver. 4. The approvalletter specifies that the activities must adhere to the conditions listed in the General Water Quality Certifications; as well as additional conditions listed in the letter. Condition(s) 2 of the approval letter states the following: If conerete is used during constxuctzon, a dry work area shall be maintained to pxevent direct contact between curing concrete and stream;water. Water that inadvertently contacts uncured concrete shall not be discharged to surface waters due to the potential for elevated pH and possible aquatic life and fish kills. [15A NCAG 02B.0200] Accordingly, Watson Contracting, Inc.is directed to respond to this letter in writing, on or before close of business on May 11, 2018. �' . �Y • / Your response shal] include the following: All sediment and erosion control measures will be inspected within 24 hours of receipt of this letter, and accurate notes regarding these inspections will be recorded in the Sediment and Erosion Control log. All needed maintenance will be performed within 3 working days of the required inspection. Photo documentation of ineasures will be taken as part of the inspection, and post maintenance, and be included in a report to be included in the reyuired response and mailed to the address below of the conditions and actions taken. � An explanation as to why the form structure for the flowabie fill failed, and as to how this will be prevented in the future. The stream relocatiori final stabilization (the replacement ofthe inappropriate matting and the placement of the stones necessary to maintain a stable channel) work shall be implemented within 15 days of receipt of this letter, with all work completed within 30 days of receipt of this letter. Photo documentation shall be included in the response requested, along with an explanation as to why it has taken so long to complete this work.
