I just (belatedly.... sorry) looked at their new application. Re: detailed mitigation plan; your call on the areas they are
proposing. I am not crazy about these piecemeal mitigation projects, but we have been accepting them in the past.
don't know if you are familiar with the proposed preservation reach. Is it something that is in danger of being
developed, or is in areas with topography such that it is unlikely to be developed? If so, I'm not sure if it represents
appropriate mitigation. I guess that is actually USACE's call to make.
With respect to the culvert issues, they did not address the issue at all. The culverts were installed improperly. Placing
medium-sized stones beneath the outlet does not fix the fact that they did not install them properly. How do we handle
this? Is this one of those situation where forgiveness is easier then permission? This hallens too often on projects,
especially the after-the-fact situations.
