Re: Additional information for Willow Creek Development, Fuquay-Varina, Wake
County, NC
On January 5, 2007, Mr. Jamie Shern of the US Army Corps of Engineers contacted S&EC
requesting additional information for the above-mentioned project; specifically, he requested that
"independent utility" between the proposed Willow Creek development and the existing
Inglenook at Willow Creek be demonstrated.
In 1997, S&EC delineated a large parcel that contained the subject property. Since that time, the
large parcel has been split into several tracts. The first tract was bounded on the east by NC 55
and on the South by Old Honeycutt Road. The second tract was bounded on the North by Old
Honeycutt Road and was approximately 1,100 feet from the intersection with NC 55. The third
tract is the proposed Willow Creek Development which is bounded on the West by NC 55 and on
the South by Old Honeycutt Road.
The original approvals for Tract 1 and a portion of Tract 2 were issued in 1997 (Action ID's
199708098, 199708099 and199708100). These approvals were for the Inglenook at Willow
Creek Development. In 2000, the remaining portion of Tract 2 was donated to the Town of
Fuquay-Varina in order for the municipality to construct a public park and recreation area, now
known as Honeycutt Park (Action ID 200021195). Mr. Todd Tugwell (formerly of the USACE)
determined in 2000 that the Honeycutt Park was indeed a separate utility from Inglenook at
Willow Creek as it was being constructed by the Town of Fuquay-Varina to serve the entire town.
The proposed Willow Creek Residential development also has separate utility from Inglenook at
Willow Creek and the developments are actually on two different sides of NC 55 and Old
Honeycutt Road. Despite sharing similar names, neither development is dependent on the other

for utilities or amenities. While both developments are and will utilize the Town of Fuquay-
Varina's Waste Water Treatment Facility, they access the WWTF through separate sewer lines
and manholes.
It is also important to note that the proposed Willow Creek Residential development itself has no
impact to any jurisdictional' areas associated with its construction. The impacts to the wetlands
and streams are a direct result from the Town of Fuquay-Varina requirement that all new
development will also improve the road frontage per the Town of Fuquay-Varina Transportation
plan. Mr. Dan Johnson, Town of Fuquay-Varina Planner commented on the conceptual site plan
for the proposed Willow Creek Development. In order for the site plan to be approved, the
developer was required to dedicate additional right-of--way in order to add a curb and gutter
section to the portion of Old Honeycutt Road that is adjacent to the property boundary.
Additionally, the developer was also required to include sidewalks along Old Honeycutt Road;
this necessitated additional right-of--way being reserved as the sidewalk must be three feet off the
back of the curb. The minimum Town of Fuquay-Varina standards require a 75 foot Right-of-
Way with 45 foot back to back streets with curb, gutter and sidewalks. This additional right-of-
way along with the required sidewalks dictated the widening of Old Honeycutt Road which
required the lengthening of the existing pipe that conveys the iJT to Black Creek under Old
Honeycutt Road. The NCDOT requirement of including a turn-lane with tapers could have been
achieved without additional right-of--way being required.
In summation, the Willow Creek Development does not share amenities or utilities with the
existing Inglenook at Willow Creek., they both have road frontage on State Highways and as
such, the existence of one does not preclude or include the other, and the jurisdicational impacts
associated with the proposed Willow Creek Development are a condition of the Town of Fuquay-
Varina Planning Board which requires that all existing roads meet the minimum town standards
and therefore, they place the burden on the developers to do the requisite roadway improvements.
