Dear Mr. Masengill:
On January 17, 2007, the Division of Water Quality (DWQ) received your application dated July 19,
2006, to temporarily impact 724 linear feet of perennial stream as stated on the Supplemental Sheet for
Item VI 4 -Stream (597 linear feet was reported in the table of cumulative impacts listed in Section VI
Proposed Impacts to Waters of the United States/Waters of the State, No. 6) and 129,221.5 square feet of
Zone 1 Neuse River basin protected riparian buffer and 117,628 square feet of Zone 2 Neuse River basin
protected riparian buffer to construct the proposed sewer line replacement project. The DWQ has
determined that your application was incomplete and/or provided inaccurate information as discussed
below. The DWQ will require additional information in order to process your application to impact
protected wetlands and/or streams on the subject property. Therefore, unless we receive five copies of the
additional information requested below, we will have to move toward denial of your application as
required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this
additional information. Please provide the following information so that we may continue to review your
project.
Additional Information Requested:
1. Please address the: aforementioned discrepancy between the temporary impact of 724 linear
feet of perennial stream as stated on the Supplemental Sheet for Item V I 4 -Stream and the
597 linear feet was reported in the table of cumulative impacts listed in Section VI Proposed
Impacts to Waters of the United States/Waters of the State, No. 6.
2. Stream crossing Nos. 1 and 10 do not appear to be perpendicular (i.e., between 75° and 105°)
Please redesign these to be within 75° and 105°. Additionally, please address whether these
are within an existing sewer easement.
3. Please indicate the width of the maintenance corridor for impact Nos. 1, 7, 10, and 11.
Perpendicular crossings that disturb greater than 40 linear feet, but equal to less than 150
linear feet of riparian buffer with a maintenance corridor greater than 10' in width are
allowable with mitigation.

4. Please clearly indicate which of the impacts are new impacts, not within the existing sanitary
sewer easement, but rather parallel. Are sections of the sewer line easement proposed for
construction within the easement, but still widening it since this is a new and larger line.
5. In Section VIII Mitigation, your response is "NA", but in the buffer table located in Section
X Proposed Impacts on Riparian and Watershed Buffers (required by DWQ), you indicated
564,106 square feet of buffer mitigation credit will be required for this project. Please
address this discrepancy.
Please contact the DWQ within three weeks of the date of this letter to verify that you have received this
letter and that you remain interested in continuing to pursue permitting of your project and will be
providing the DWQ the requested information at a later date. Please contact me in writing and Mike
Horan of the DWQ Raleigh Regional Office. If we do not hear from you within three weeks, we will
assume that you no longer want to pursue this project and we will consider the project as withdrawn.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters
or protected buffers. Please be aware that any impacts requested within your application are not
authorized (at this time) by the DWQ. Please call Ms. Cyndi Karoly or Mr. Ian McMillan at 919-733-
