Oriental, NC 28571 Subject Property: Bairds Creek Landing Beards Creek, Neuse Basin, 030410, 27-111, NSW, SC, Sw REQUEST FOR MORE INFORMATION Dear Mr. Hollowell: On March 16, 2009, the Division of Water Quality (DWQ) received a letter from your consultant, Dennis Fornes, with information addressing issues indicated in a "Request for More Information" letter sent to you on November 18, 2008. Upon review of your application and the additional information the DWQ has determined that your request for certification was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetland, streams and/or buffers on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H.0506 and 2B .0233(8) and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. PCN Revision Please provide a revised Page 11 of 12 of the PCN application. The riparian buffer impacts should be quantified in the PCN application. 2. Cross Sectional Detail of Crossings Please provide cross sectional detail of each proposed crossing. Page 2 of 2 counter sinking of each culvert, and stabilization is achieved at each crossing. 3. Stream Crossing The DWQ does not have information indicating that there was a stream call performed for crossings 2 and 3. Please provide information that the DWQ has performed a stream evaluation on those streams to determine if those streams are ephemeral, intermittent, or perennial. 4. Quantify Total Stream Impact Please quantify all impacts associated with stream crossings. Upon review of your project request the DWQ determined that the impacts indicated on the project plans are greater that what was indicated in the application. Impact request should include total culvert length, headwalls, and if applicable any stream armoring. Please respond in writing to the DWQ within four weeks of the date of this letter to with the requested information. If we do not hear from you within four weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
