The description ofthe proposed action provides adequate assurance that the proposed action in the Yadkin Pee Dee River Basin in conjunc[iun with the proposed development will not result in a violation of applicable Water Quality Standards and dischar�e guidelines. Therefore, the State of North Carolina certifies that this activity will not viola[e the applicable portions of Section 301, 30?, 30;. 306, 307 of PL 92-500 and PL 95-217 if conducted in aceordance wi[h the application and conditions hereinafter set forth. Should your project chan,e, }'ou mus[ notify [he NCDWR and submit a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter, and is thereby responsible for complyin, with all the conditions. If total wetland fills for this project (now or in the future) exceed one acre, or of rotal impacts to streams (now or in the future) exceed 300 linear feet, compensatory mitigation may be required as described in I SA NCAC 21i .0506 (h) (6) and (7). For this approval to remain valid, you must adhere to the condi[ions listed in the attached certification(s) and any additional conditions listed below. Proposed impacts are covered by General Water Qualiry Certihcation Number 4135, of which corresponds ro Nationwide Perinit 14 issued by thz Corps of Engineers. All Conditions of the original Water Quality Certification dated December 31, 2014 and subsequent modifications still apply except where superseded by this Certification. If you wish to contest any statement in the attached Certification you must file a petition for an administrative hearing. You may obtain the petition form from the office of Administrative hearings. You must file the petition with the office of Adminishative Hearings within sixty (60) days of receipt of this notice. A petition is considered filed when it is received in the office of Administrative Heazings during normal office hours. The Office of Administrative Hearings accepts filings Monday through Friday between the hours of 8:OOam and S:OOpm, except fot official state holidays. The original and one (1) copy of the petition must be filed with the Office of Adminishative Hearings. The petition may be faxed-provided the original and one copy of the document is received by the Office of Administrative Hearings within five (5) business days following the faxed transmission.
