DENR - *ATER UUALITy I*Tl,A,NDS AND STOLUAyA'ER 8RANCM SUBJECT: Consistency Certification Submission Status for Proposed Impacts to 0.72 Acres of Wetlands to Facilitate the Expansion of a Truck Stop, Wilmington, New Hanover County, North Carolina (DCM#20090008) Dear Ms. Kolb: We received the consistency certification of Southern Environmental Group, Inc. (SEGi) on behalf of Mr. William H. Smith ("Applicant") on February 2, 2009 for proposed impacts to 0.72 acres of wetlands to facilitate the expansion of Scotchman #303 Truck Plaza. The proposed expansion involves the installation of concrete retaining walls, parking area, and dumpster pad. The project site is located at 1610 US Highway 421 North in Wilmington, New Hanover County, North Carolina. The Division of Coastal Management does not typically issue a consistency concurrence decision until the Applicant has obtained all other required State permits and/or permissions and submitted copies of them to DCM. Since the Applicant has yet to obtain these approvals, DCM will be unable to issue either a letter of "concurrence" or "objection" by May 2, 2009. Based on the requirements of 15 CFR 930.62, DCM has until August 2, 2009 to either concur or object to the consistency certification unless an extension agreement is obtained. Upon the receipt of the required State approvals, we will make every effort possible to complete our review before the deadline.
