This is a reminder of what the Division of Water Resources (Division) is requiring before the 401 can be approved. On April 5, 2018, the Division received the subject application dated March 12, 2018, requesting a 401 Water Quality Certification from the Division for the subject project. The Division has determined that your application is incomplete and cannot be processed. The application is on hold until the following items are addressed: Drawing number ES -01C depicts the rip -rap apron being 10 feet in width, but the channel is only 4-6 feet wide. Please provide an explanation of how you will meet condition number 11.11 of the water quality certification 4139 (attached) which states, "the dimension, pattern, and profile of the stream above and below a pipe or culvert shall not be modified by widening the stream channel." Please revise the detail or provide justification for the width. [15A NCAC 02H .0506(b)(2) and (c)(2)] Please provide a detail of how the stream banks will be stabilized below the culvert outlet. Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested information for the proper consideration of the application. If all of the requested information is not received within 30 days, the Division will be unable to approve the application and it will be returned.
