Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: Providence Village (formerly known as Star City Tract) is located southeast of the Interstate 485 and Providence Road in Charlotte, North Carolina (Figure 1, Attachment A). The project area currently consists of an active construction site for multi-family residential development. Surrounding land uses consist of forested areas, commercial properties, and single- and multi-family residences. The United States Geological Survey (USGS) Topographic Map (Figure 1) and the United States Department of Agriculture - Natural Resources Conservation Service (USDA-NRCS) Soil Survey (Figure 2) are included in Attachment A. The USDA-NRCS soil survey does not depict any jurisdictional features within the project limits. The USGS topographic map depicts a stream in the eastern portion of the property that was classified as a wetland during the wetland delineation in 2013 (previous JD information – Attachment I). Approximately 0.15 acre of the 0.16 acre on-site wetland has since been impacted during site development. 3b. Explain the purpose of the proposed project: The purpose of this project is to develop the property into a multi-family residential development. This project will provide residential housing for Charlotte, North Carolina to meet the growing demand for housing due to population growth. Page 3 of 13 PCN Form – Version 1.4 January 2009 3e. Describe the overall project in detail, including the type of equipment to be used: Project History The General Permit Verification for NWP 29 was issued on November 13, 2015 (SAW 2015-02113). The Nationwide Permit and associated Water Quality Certification expired on March 18, 2017. Therefore, the permittee had until March 18, 2018 to complete the proposed impacts. Copies of the expired General Permit Verification and Water Quality Certification for this project are included as Attachments C and D, respectively. The permittee changed from Crescent Communities to Pulte Home Company, LLC in December 2017, when Pulte purchased the portion of the property where the Wetland AA (the only on-site wetland) was located (Mecklenburg Tax Parcel ID. 23113138). As the permittee changed since the original permit application in 2015, the permit transfer letter was forwarded to the U.S. Army Corps of Engineers (USACE) on April 4, 2018. This After-the-Fact Permit application includes the 13.8-acre portion of the project owned by Pulte Home Company, LLC (Mecklenburg Tax Parcel ID. 23113138). A change in the approved plan design was made in early 2017; however, due to a clerical oversight, the revised plan was not forwarded to the USACE. The plan change did not affect the quantity of the impacts. The new design moved the stormwater control measure to the northeastern portion of the property from the southeastern portion of the property. The plan was approved by City of Charlotte and exceeds the requirements for stormwater water quality treatment. The most current site plan is enclosed as an Attachment E. Current Project Status and Completed Activities On April 4, 2018, Carolina Wetland Services, Inc. (CWS) scientists Aliisa Harjuniemi, Professional Wetland Scientist (PWS), and Megan Shelton, Staff Scientist I, visited the Providence Village site to review the completed project activities and determine if the project is in compliance with the Nationwide Permit Authorizations. The authorized wetland impacts totaled 0.16 acre of permanent impacts to Wetland AA. Figure 3 depicts the original site plan permitted in 2015 (Attachment A). Based on the April 4, 2018 site visit, the project has impacted a total 0.15 acre of jurisdictional wetland area (Figure 4, Attachment A). Therefore, the completed impacts are slightly less than the authorized impact area and are within the same footprint as the authorized impacts. The contractor, J. O. Flowe Grading Company, started grading operations on January 22, 2018, and the excavation and fill of the wetlands was completed by February 26, 2018 (Attachment F). Photographs 1-3 (Attachment G) are representative of current site conditions. Typical heavy equipment were used in grading operations (bulldozers, excavators, dump trucks, graders, etc.). Fork lifts and man lifts will be used for loading materials and access. As the impacts to wetlands exceeded the mitigation threshold, compensatory mitigation was required in 2015. In compliance with the required conditions of the permit, the required mitigation fee for the entire proposed wetland impacts was paid to the Division of Mitigation Services after receiving the original permit verification (SAW-2015-02113). The receipt for the mitigation payment is enclosed as Attachment H. CWS forwarded documentation of the completed activities within the Waters of the U.S. to the USACE on April 9, 2018. On April 10, 2018 Mr. David Schaeffer from the USACE requested an After-the-Fact permit for the project to be in compliance with Nationwide Permit General and Regional Conditions. After-the-Fact Permit Grading and fill associated with the residential areas, roads, and site fill slopes resulted in 0.07 acre of permanent wetland impact (W1; Figure 4). The fill slopes for the stormwater treatment measure permanently impacted 0.08 acre of the wetland (W2; Figure 4). Since the stormwater treatment measure fill slopes were placed on the jurisdictional wetland area, the project is not in compliance with NWP 29 Regional Conditions. The stormwater treatment measure had been designed appropriately for the project purpose and has been approved by the City of Charlotte. The outfall of the stormwater treatment measure is outside the wetlands. It is our opinion that relocating this stormwater pond would negatively impact the waters due to increased sediment deposition, and relocation or redesign of the stormwater feature is not feasible within the approved plan design. Therefore, our client requests that the stormwater control measure be left in its current position and to be permitted After-the-Fact as a minor discharge under Nationwide Permit No. 18. No additional impacts to jurisdictional waters are planned for this phase of the project. As the Water Quality Certification corresponding to the Nationwide Permit Nos. 29 and 18 is the same for both of these Nationwide Permits, the project is in compliance with the Water Quality Certification conditions. A copy of this permit will be provided to North Carolina Division of Environmental Quality (NCDEQ) as the project’s layout has changed. Page 4 of 13 PCN Form – Version 1.4 January 2009 4.
