As requested, this email contains my scoping comments for TIP project U-6018,
improvements along NC 62 near the NC 62/I-85 interchange in Archdale in Guilford
County. NCDOT requested that our agency provide information that would be helpful in
evaluating potential environmental impacts of the project, including the identification of
any permits or approvals which may be required. My review included the information
you provided and an evaluation of existing Corps regulatory actions and remotely
sensed resources including aerial photography, Guilford Co. Soil Survey, LiDAR, and
USGS topographic maps. Although the corridor generally occurs along a topographic
ridge, the study area extends near or into the heads of several drainages that contain
unnamed tributaries to Mile Branch, Richland Creek, and Muddy Creek. Within these
drainages are numerous potential waters of the US (i.e. streams, wetlands, ponds).
Documented Corps regulatory actions in the project vicinity include R-2606 (US 311;
SAW-2004-00340) and an Archdale sewer improvement project along I-85 (SAW-206-
41431).
As with all projects, a delineation of any potential waters of the US within the study area
and subsequent Corps verification would be necessary as part of the permitting process.
If any of the proposed project activities involve a discharge of dredged or fill material in
waters of the US, the project will require Department of Army authorization.
Typical NCDOT interchange improvement projects could be authorized by Nationwide
Permits (NWPs) 14 or 23 (with a CE), or Regional General Permit (RGP) 31 (if part of a
widening project), given documentation of avoidance, minimization, and compensatory
mitigation (if warranted). Note that, authorization via RGP 31 for impacts in excess of
500 I.f. of stream and 1 ac. wetlands is only possible if the project has undergone
interagency review and completed the current interagency Merger Process. Whether or
not the Corps would recommend that this project proceed through the Merger process
depends on several issues, one being the extent to which our agency partners see a
benefit in Merger for resolving potential resource conflicts. If the other agencies do not
suggest that the project proceed through Merger, the Corps requests further discussion
with NCDOT regarding the appropriateness of Merger review for this project, as certain
permitting avenues are Merger-dependent.
