Dear Mr. Maple:
On March -12, 2018, the Division of,Water Resources, (Division') received.your application dated
,March 10, 2018 requesting a Minor Variance from the Division. for your project. The Division
has determined that your application is incomplete and'cannot be processed. The application is
on -hold until the following informati®n is received: .
1. Please clearly identify and depict the footprint 'of the 388 square feet of Zone 2 riparian
buffer impacts on the site plan. The Division recommends highlighting by hatching or
shading the.permanent buffer impact areas. As the' application stands, it is not clear,'
where Zone 2 impact are located, the location of the existing deck, and the location of
the existing porches etc. The deck and porch are existing uses. 'These areas must be
identified and distinguished from the remaining/proposed zone 2 impacts in the
application in order to complete the review of the proposed impacts.

2. Your project requires 582 square feet of buffer restoration -.please provide a complete
detailed mitigation plan (including a detail sheet, specifying the restoration area) for this
project. The plan must include a minimum of at least two native hardwood tree,
species, date of plantings, the date of the one-time fertilization in the riparian protected
riparian buffers and a plan sheet showing the proposed location of the plantings.

® This plan must be developed to ensure that at least two native tree species are
planted at, a density sufficient to provide 320 trees per acre at maturity. This
density is usually achieved by. planting -approximately 436 trees per acre on a 10
ft. x 10 ft. grid or 681 trees per acre on an 8 ft. x 8 ft.:grid. This plan must include
the types of native -woody vegetation selected, methodology of planting, and a
site map indicating the location of the replanting efforts.
3. Buffer mitigation can also be met through payment of a compensatory mitigation fee to
a private mitigation bank or NC Ecosystem Enhancement Program.(NC EEP) if mitigation
is not available from a private mitigation bank. A list of available mitigation banks can
be found online at: http://portal.ncdenr.org/web/wq/nutrientbufferbanks: Information
regarding NC EEP's procedures.for requesting and purchasing mitigation may found
at http://portal.ncdenr.org/web/eep/mitigation-applicants. If mitigation is proposed
through a private mitigation bank or NC EEP, the acceptance letter must beincluded in
the application package specifying that they have the appropriate number of credits
that your project requires. DWR recommends that you request the maximum possible
mitigation amount that may be required so that you will not have to get further
approval on short notice. 15A NCAC 0213 .0260 .
Pursuant to Title 15A NCAC.02H .0502(c) and,Title 15A NCAC 02B .0233 (8), the applicant shall
furnish all of the above requested information -for the proper consideration of the application.
If all of the requested information is not received in writing within 30 calendar days of receipt
of this letter, the Division will be unable to approve the application and it will be returned. The
return of this project will necessitate reapplication to the Division for approval, including,a
complete application package and the appropriate fee.
Please respond in writing within 30 calendar days of receipt of this.letter by sending four copies
of all of the above requested information to the 401 &Buffer- Permitting Unit, 1617 Mail Service
Center, Raleigh, NC 27699-1617.
Please be aware that you have no authorization under the Water Quality Certification Rules or
the Neuse Riparian Buffer Rules for this activity.
