Re: Availability of Riparian Buffer Mitigation Credits .
Project: Porto Fino Subdivision Shared Lots
We are providing this letter to confirm that 81,130.50 sf of Riparian Buffer Mitigation
Credits (Credits) from the Weaver Fargo Nutrient Mitigation Bank (Bank) are currently
available and all or a portion may be used, once transferred, for compensatory mitigation
relative to the Porto Fino Subdivision Shared Lots project, and as proposed by Trevi
Fountain Associates LLC, Ekaterina Cady (Applicant).
The Applicant may ultimately purchase the Credits, if they are available, following Permit
issuance. Should the Applicant purchase the Credits at that time, we will complete and
execute the Mitigation Credit Transfer -Certificate.
We will additionally provide copies of the completed and executed Transfer Form to the
Applicant and NC Division of Water Resources. Transaction information in the updated Bank
Ledger will include relevant Permit and Applicant information as well as the number and
resource type of the debited Credits.

Restoration Systems Mitigation Credit Terms & Conditions.
- Credits are on first come/first serve basis.
- If permittee would like to "reserve" credits, a 20% deposit on the total credit
purchase is required for a 4 month reservation and"price lock or until permit is
issued, whichever occurs first. This is non-refundable unless the permit is not issued.
If no deposit is made credit prices are subject to change without notice.
Statement of Availability Letter will not be issued more than 5 calendar days before
permit application submittal.
Executed Sales Agreement is required for invoice.
- Once permittee is invoiced, credits are held for 30 calendar days. If payment isnot
made in 30 days, credits are released and prices are subject to change.
- If no deposit is placed and at any time credits become unavailable RS will notify the
Army Corps of Engineers agent and consultant.
