This letter is in reference to Dallas Harris Real Estate's Property, Westbay Estates in Ogden, New
Hanover County, North Carolina. Specifically in reference to proposed wetland impacts for
completion of the subdivision.
My client is proposing 0.61 acres of wetland impacts to Section 404 wetlands. These impacts
consist of 0.48 acres for eight (8) road crossings and 0.130 acres for lot fill. In addition, 48,667
(2.79 acres) of ditches, classified as Waters of the US, are proposed to be filled. (see attached
impact detail sheet).
The avoidance of the majority of wetlands within th project area was accomplished during design
phase of the project. Unavoidable wetland impacts were minimized by eliminating a number of
lots within the subdivision. Specifically lots were eliminated in areas where lots appeared to be
un-buildable. In addition, best management practices will be utilized during the construction
phase of the project to ensure no secondary impacts occur.
My client proposes to mitigate for the road crossings and lot fill impacts by restoring
approximately 1.18 acres of wetlands within the project. In order to mitigate for the impacts to
ditches classified as Waters of the US, my client proposes to construct 50,613 (3.74 acres) linear
feet of grassed swales through out the site. (see attached mitigation plan).
