Dear Mr.Yancy:
The Division understands from your application that you propose to develop several contiguous real
estate parcels into a 1.45-acre apartment complex with subterranean parking.You intend that construction
excavation dewatermg, and a permanent drain system for parking will discharge to a local stormsewer
under zero-flow receiving-stream conditions(7Q10 and 30Q2=0.0 cfs),the final receiving-stream
classified water-supply WS-W,NSW.
Your written comments on the permit draft(submitted by your consultant,Mid-Atlantic,Inc.,February
23, 2018)included new effluent data,presented as supplement to your application. These new data show
a contribution to the waste-stream of oxygen-consuming wastes(BODS,TKN and Ammonia)not
previously presented.We note concentrations significantly exceeding water-quality standards,
specifically in samples POTW-5 and POTW-6(your Attachment,Table 3).
Please note that 15A NCAC 02B .0206(d)(2)states:
• "If the 30Q2 and 7Q10 flows are both estimated to be zero,no new or expanded
(additional)discharge of oxygen consuming waste will be allowed.Requirements for
existing discharges to streams where the 30Q2 and 7Q10 flows are both estimated to be
zero will be determined on a case-by-case basis."
As your proposed discharge is a new discharge of oxygen-consuming wastes,your proposal is disallowed
by Rule.We regret not understanding the full effluent chemistry prior to submitting a permit draft.If you
