This permit, issued on April 8, 2009 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) Unless specifically altered herein, this minor modification authorizes a +/- 2,500 linear foot increase in the limits of the authorized beach nourishment projects, all as depicted in the attached workplan drawings and project narrative. 2) This minor modification shall be attached to the original permit #6-01, which was issued on 1/19/01, as well as the renewal of 9/24/04, and copies of all documents shall be readily available on site when Division personnel inspect the project for compliance. 3) All conditions and stipulations of the active permit remain in force under this minor modification, unless specifically altered herein. (See Attached Sheet for Additional Conditions.) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Based on our current design, the beach disposal limits have increased by 2,500 linear feet, when compared to the limits authorized by Permit #6-01. Increasing the linear feet of the proposed beach disposal area from 9,000 feet to 11,500 feet. We have included an updated project narrative, as well as current and previous drawings. Please note we did not include the entire packet of permit drawings, as no alterations have occurred, since they were originally submitted November 4, 2008. Access to the Atlantic Intracoastal Waterway, via Rich Inlet, is achieved by navigating through Nixon Channel. Nixon Channel regularly experiences shoaling and channel migration, due to the naturally occurring hydrodynamics of the inlet/channel system. Several permits have been issued in the past in order to maintain the safe passage of marine vessels through Nixon Channel. Each of following permits authorized the dredging of Nixon Channel and spoil placement along the north end beach of Figure "8" Island: • CAMA Permit # 89-83 (April 4, 1984) • CAMA Permit #21-93 (January 20, 1988) • CAMA Permit # 6-01 (January 19, 2001, renewed September 24, 2004) Each of the above referenced permits have placed the beach quality sand excavated from Nixon Channel on the north end of Figure "8" Island. The beach nourishment efforts in the years 2000 and 2004 extend from the north end to approximately 246 North Beach Road, with a total length of 9,000 linear feet. Our current drawings (October 2008) depict the limits of beach fill extending to 200 North Beach Road, with a total length of 11,500 feet. Thus extending the proposed beach fill area an additional 2,500 feet. Based on CAMA Permit # 12-99, authorized beach nourishment activity extended from Mason Inlet up to 250 North Beach Road. Which included the additional 2,500 feet of shoreline we are proposing to incorporate into the Permit 6-01 minor modification. See the illustration below: For illustration purposes only, not intended for engineering, construction, or field use. Purpose The overall purpose of the proposed activity is to provide safe passage of marine vessels through Nixon Channel. The permitted design depth of Nixon Channel is 9 -ft below mean low water (MLW). The channel has shoaled in significantly, and an intertidal sand bar has formed within the eastern portion of the channel. The proposed maintenance dredging and spoil area is within the same previously permitted project limits. Additionally, Hurricane Hannah and the September 20, 2008 nor -easter caused significant beach erosion along Figure "8" Island, specifically in the proposed spoil area. Therefore, the placement of beach quality sand in the spoil area will provide well need material to an eroded beach (see drawings). Project Description Approximately 297,000 cubic yards (cy) of beach grade sand is expected to be removed from the excavation area, which is 100,000 cy less than the previous maintenance activity. The design channel depth does not exceed 9.0 feet below Mean Low Water (MLW). The sand within the permitted excavation area will be removed via hydraulic dredge, and discharged by an extended 24" pipe. It is expected that 7,000 — 12,000 cy of sand will be discharged per day, and the disposal volumes will be approximately 27 cy/ft. The entire disposal area will span 9,000 linear feet, from the north end of Figure "8" Island southward to 200 Beach Road North. The timeframe of construction will be between 35 — 50 days, and is currently in progress. The role of GBA, Inc. will be to monitor all construction activity and ensure the project remains in compliance with Permit # 6-01. Based on past permits and beach fill activity the proposed modification to this permit should have no adverse affects to the Figure "8" Island shoreline or surrounding environment. Furthermore, it is within the area previously authorized under Permit 12- 99.
