401 Water Quality Certification - Storm water Condition Violation
Dear Mr. Dane Vicent:
On March 4, 2009, Natalie Landry and Autumn Hoban from the Raleigh Regional Office of the
Division of Water Quality (DWQ) conducted a follow-up site inspection for the tract/project
known as Governors Village located off Farrington Mill Road, in Chatham County, North
Carolina.
Thank you for your prompt attention to address the Notice of Violation. Our observations from
the follow-up inspection are listed on page 2 of this correspondence. Your time and consideration
during the follow-up inspection was greatly appreciated.
The wet pond of Governors Village flows to waters of the state, an unnamed tributary (UT) to
Jordan Lake, Jordan Lake Watershed Protected Area, Class WS (Water Supply) IV, NSW-
Nutrient Sensitive Waters, in the Neuse River Basin.
Operations and maintenance is required "from the time of first occupancy going forward" as
indicated by condition 7. (Stormwater Management) of the 401 Water Quality Certification.
Failure to operate and maintain as per the approved O & M manual is a violation of the 401
Water Quality Certification conditions.

The following observations were noted during the follow-up inspection:
1. The initial treatment/removal of the aquatic invasive plants has been completed.
A follow-up treatment is expected, as needed, prior to replanting efforts.
2. The replanting of the aquatic shelf to comply with the 401 planting plan is
scheduled for spring 2009.
3. The erosion and rilling of the banks have been repaired and the ground cover has
been established.
4. The site is now reported to be in compliance with the Chatham County Sediment
and Erosion Control Plan.
The trash rack has been cleaned and the vegetation removed.
6. As built drawings, including any modifications that differ from the approved
design, were completed and submitted to DWQ.
7. A grass filter strip has been successfully established below the level lip spreader.
8. The amount of base flow continually entering the level spreader will be addressed
by coring an adjustable orifice in the riser structure and manually determining the
appropriate orifice diameter through field testing. The objective is to relieve the grass
filter strip of constant saturation.
Requested Response
1. Please schedule another inspection with us upon the completion of the remaining items
above. Specifically, address items: 2, 4, 6, and 8 to come into compliance with the
conditions of the 401 Water Quality Certification.
Thank you for your attention to this matter. This office requires that the violations, as described
above, be properly resolved. These violations and any future violations are subject to a civil
penalty assessment of up to $25,000.00 per day for each violation. Should you have any
