PROJECT SUMMARY: The applicant proposes to install one (1) additional boatlift at an existing docking facility adjacent to the Davis Canal. Eric Schmidt c/o Randy Mosley Page 2 PROJECT DESCRIPTION The project site is located at 107 East Island Drive within the Town of Oak Island, adjacent to the Davis Canal, in Brunswick County. To find the project site from the Wilmington District Office, tum left off Cardinal Drive on to Market Street. Travel 0.4 miles and tum right on to Martin Luther King Jr. Pkwy (US -74). Travel 5.3 miles and merge right on to NC -133. Travel 0.7 miles, crossing over the Isabel Holmes Bridge, until you reach US -17. Tum left on US -17 and travel 1.1 miles, keep right and merge on to NC -133 S/US-17 S. Travel 2.6 miles and take the US -17 exit toward Shallotte /Myrtle Beach. Continue 0.8 miles on to US -17 S/ Ocean Hwy E. Travel 13.1 miles and then tum left on to US -17 BUS. Travel 1.7 miles and tum left onto NC -906. Continue 10.7 miles and tum right on to W. Oak Island Drive. Travel 1.6 miles and tum left on to SW 281h St. Continue on for 0.2 miles and tum left on to E. Island Dr. Proceed 246 feet and the property is on the right-hand side. The property is approximately 9,148 sgft (0.21 acres) and currently has approximately 60 linear feet of shoreline which is stabilized by a timber bulkhead and a two -slip docking facility. There are no residential structures on the property and the property has an average elevation of approximately 4 feet above normal high water (NHW). To the east of the subject property is a vacant lot with a bulkhead, and to the west of the property is a single-family dwelling with a bulkhead and docking facility. To the south of the subject property on the waterward side of the existing bulkhead is the Davis Canal and a 15' wide by 60' long low marsh fringe consisting of Smooth Cordgrass (Spartina altemiflora). Upland vegetation on this lot consists primarily of lawn grass of various hardwood species. A docking facility was authorized under General Permit #53915D on March 12, 2010 and consists of a 16' in length and 4' in width elevated pier that connects to a 12' in length by 16' in width fixed platform. An access ramp leads to a 13' in length by 16' in width float and a 13' in length by 13' in width boatlift located on the west side of the float. The docking facility is located approximately 35' from the nearest adjacent existing docking facility to the west and approximately 100' from the nearest docking facility to the east. The applicants current docking facility is authorized for up to two (2) vessels. The Town of Oak Island 2017 Land Use Plan classifies the high ground portion of the property as Single -Family Residential. The waters of Davis Canal are classified SA; HQW by the Division of Water Resources, and they are CLOSED to shellfishing. This section of the Davis Canal IS NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. PROPOSED PROJECT The applicant proposes to install one (1) additional boatlift at an existing docking facility adjacent to the Davis Canal. The applicant proposes to install a pile supported boatlift measuring 13' in width by 13' in length. The boatlift will be located on the east side of the existing docking facility and accessed by the existing floating dock. The new boatlift will provide for one (1) additional boat slip to the existing 2 slip docking facility for a total of three (3) vessels within existing water depths of approximately -2.0 ft. to -6.0 ft. at NLW (See Sheets 1 and 2 of 2). As proposed, the new boatlift would not extend beyond the end of the existing docking facility in to the waterbody but it would encroach 11' within the adjacent riparian 15' corridor setback to the east. Neither of the adjacent property owners object to this project and the property owner to the east has waived their 15' riparian corridor setback for this project. 10. ANTICIPATED IMPACTS The proposed boatlift would incorporate an additional approximately 169 sq. ft. of Estuarine Waters and Pubic Trust Area. The additional boatlift is proposed in an alignment that would not exceed the most waterward extent of the existing docking facility measuring approximately 41 feet into a waterbody, which measures approximately 153 feet across. This distance exceeds the %width rule, however, would conform to the 1/3 width rule or 51 feet, for a pier meeting the established pier -head line, which is consistent with the rules at the time of the issuance of the original permit for the existing docking facility. The proposed expansion of the existing docking would provide one (1) additional docking space for a total of three (3) vessels within existing water depths between -2.0 ft. and -6.0 ft. at NLW. The proposed structures would encroach 11' into the adjacent 15' Riparian Corridor Setback Area to the east, however the adjacent riparian property owner has waived the setback requirement. There are already 2 existing slips and the lift will create a 3rd slip. There is 60' of existing bulkhead along Davis Canal, 4'x18'6" walkway, 12'x16'6" platform, wooden gangway, 12'x16' floating dock and a 12'6"x12'6" boat lift. Coastal wetlands in front of existing bulkhead and grass lawn covering cleared lot upland of the bulkhead. The lift will be installed by driving 4 poles from a 10'x30' self propelled barge.
