Dear Mr, Delmus:
On February 19, 2018, the Division of Water Resources (DWR) received a request from Daniel
Taylor of Wildlands Engineering, Inc. to appeal an on-site determination made by the DWR
Washington Regional Office as provided in 15A NCAC 02B .0233 (3). On April 3, 2018, Anthony
Scarbraugh of DWR, conducted an on-site determination to review the feature located on the
subject property for applicability to the Neuse Buffer Rules (15A NCAC 02B.0233).
The feature evaluated is labeled as "20120144 VV on the attached maps initialed by Anthony
Scarbraugh. This feature appears on the USGS Topo 1-24,000 map. During the review, Mr.
Scarbraugh evaluated the feature using the DWR Stream Classification Form. Feature 20120144
V4 was evaluated and determined to be an agricultural ditch, and therefore, NOT SUBJECT
throughout the reach to the Neuse Riparian Buffer Rules. This feature continued upstream and
downstream of the subject property.
The feature evaluated is an unnamed tributary to Buck Swamp, Class WS -IV, NSW waters within
the Neuse River Basin. The form and maps are attached to this letter.
This determination, DWR Project # 20120144 V4, shall replace the determination originally
performed by the DWR Washington Regional Office as documented in their letter dated
January 29, 2018 and reference number DWR #12-0144 V3. This determination shall expire five
years from the date of this letter.
This determination can be contested as provided in General Statute 150B by filing a written
petition for an administrative hearing to the Office of Administrative Hearings (hereby known as
OAH) within sixty (60) calendar days.

A petition form may be obtained from the OAH at or by calling the OAH
Clerk's Office at (919) 431-3000 for information. A petition is considered filed when the original
and one (1) copy along with any applicable OAH filing fee is received in the OAH during normal
office hours (Monday through Friday between 8:00am and 5:00pm, excluding official state
holidays).
The petition may be faxed to the OAH at (919) 431-3100, provided the original and one copy of
the petition along with any applicable OAH filing fee is received by the OAH within five (5)
business days following the faxed transmission.
