Project Manager 909 Capability Drive, Suite 3100 Raleigh, North Carolina 27606 Dear Mr. Webster: This correspondence is in reference to the Casey/King Mitigation Bank which is located off of British Road (NCSR 1803), adjacent to Heath Branch, near Kinston in Lenior County, North Carolina. This letter also confirms our onsite meeting with members of the MBRT on January 28, 2009, to inspect the bank to determine if restoration success criteria have been met on this site and to confirm the status of mitigation credits available from this bank. Inspection of the site by the MBRT revealed that the success criteria have been met and you are hereby notified that the restoration work you have undertaken on the Casey/King site is considered successful and no additional monitoring will be necessary at this time. Based on the credit release schedule contained in the mitigation banking instrument (MBI) and the Site Specific Mitigation Plan the remaining 25% of credits will be released if the bank meets the overall objectives set forth in the Site Specific Mitigation Plan. By copy of this correspondence, we confirm that you have satisfied the above requirements and a total of 37.3 credits constituting 100% of the Bank's total restoration credits are now available for sale.
