sampling procedures are not adequate to make the assertions that they have as it pertains to
the invertebrate density present in this UT. In other words, if they are going to continue
this line of argument (that the invertebrate community is both too low in density as well as
diversity) to merit a minimum release requirement they are going to have sample (and then
process the sample) more intensively.

I have attached my comments for the SEPA - DWQ# 14002 - Southern Pines Emergency
Reservoir document.
My comment didn't change much from the last submission.
I still think, based on the information from DWQ biologist, that we should require a
minimum release. I understand that DWR has a policy - to not require minimum releases on
small watersheds, but DWQ has the power to require these through the permitting process.
I think we should try to do unless there are special circumstances. When I spoke to DWR
during the last round and they gave me the impression that their hands were tided and
that they expected us to step up and be the enforcer of this requirement.

Dear Mr. White:
Please reference your application for Department of the Army(DA) authorization to
impact Section 404 jurisdictional Waters of the United States, including wetlands,
adjacent to an unnamed tributary to Horse Creek, a tributary to Drowning Creek, for the
purpose of constructing a new raw water storage reservoir for the Town of Southern
Pines,Moore County,North Carolina. The 52 acre project area is located west of U.S.
Highway 1, south of Thunder Road(NCSR 1102), southwest of the Town of Pinebluff,
North Carolina. The proposed impacts include the discharge of fill material into 0.7 acre
of wetlands and 277 linear feet of stream channel and the flooding of 0.9 acre of
wetlands, 167 linear feet of stream channel and 1.4 acres of open water.
In a letter dated October 18, 2006, this Office forwarded the comments and concerns
received during the Public Notice period to you for your consideration and action. On
November 1, 2006, we received your letter requesting additional time to respond and to
begin an Enviromnental Assessment(EA),presumably due to the requirements of the
State Environmental Policy Act(SEPA). We have considered your request to keep the
file active; however, in discussion and agreement with your agent,J. H. Carter III&
Associates, Inc., it seems that the period of time you will need to address these issues may
be indefinite. Therefore,we have withdrawn your request and closed the file. Once you
have obtained all of the necessary information, finalized a draft EA, and started the SEPA
process,you are welcome to reapply,for DA authorization. I recommend that you,your
agent, and engineering consultant contact this office for a meeting prior to re-submittal.
