Director Division of Water Quality December 27, 2006 DWQ Project # 2006-1798 Johnston County Page 1 of 2 CERTIFIED MAIL: RETURN RECEIPT REQUESTED Mr. Ronald Mikesh 3061 Berks Way Suite 202 Raleigh, NC 27614 Subject Property: Summerwind Plantation, Garner, NC UT to Swift Creek [030402, 27-43-(8), C, NSW] REQUEST FOR MORE INFORMATION Dear Mr. Mikesh: On November 15, 2006, the Division of Water Quality (DWQ) received your application dated November 14, 2006 to permanently fill 0.048 acres of forested wetlands, 145 linear feet of intermittent stream, 2,733 square feet (ft2) of Zone 1 protected riparian buffers and 1,695 square feet (ftZ) of Zone 2 protected riparian buffers to construct the proposed subdivision and associated roads. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetland, streams and/or buffers on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and 2B .0233(8) and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: I . In your application, you state that it is a courtesy copy. For coverage under the Corps of Engineer's Nationwide 39 and the corresponding Water Quality Certification #3402, impacts to any stream length in the Neuse, Tar-Pamlico or Randleman River Basins will require written concurrence from DWQ. Since your project is in the Neuse River Basin, you will need to submit a permit fee. Please note that beginning January 1, 1999, the N. C. General Assembly passed legislation requiring payment of a fee for all 401 applications, as indicated on page two of the PCN application form. The fee for applications is $200 for projects impacting less than an acre of wetlands and less then ISO linear feet of streams. For projects impacting one or more acres of wetlands or 1 SO or more feet of streams, the fee is $475. In order to process your request, you must send a check in the appropriate amount made payable to N. C. On-Site Determination It does not appear that the DWQ has been to your property to confirm if surface waters exist and if the surface waters are intermittent or perennial. Please contact the DWQ Raleigh Regional Office to conduct an on-site determination to confirm whether the surface waters on your site are intermittent as your application states. You also have the option of contacting DWQ's Express Permitting Unit instead of the Regional Office to have them confirm the surface waters on your property for a fee. Please provide a complete set of plan sheets at a 1"=50' minimum that will clearly show all proposed impacts. Do not submit each impact on a separate sheet. Ensure you also send a copy of these plan sheets and the wetland map to Jamie Shern with the Corps of Engineers. 4. In Section XI of your application, you state that the project will exceed 20% impervious acreage. Please provide a breakdown of how you arrived at your impervious amount. The breakdown should include, but is not limited to, the house footprint, driveways, sidewalks and roads. Be aware that for projects in nutrient sensitive waters, you will need to have a stormwater plan that includes the use of a constructed wetland, bioretention or a wet pond followed by a forested filter strip. If your project does exceed 30% be sure to include the stormwater plan with your resubmittal. 5. Please complete and submit Sections N, V, and XN of the PCN form. Please respond within three weeks of the date of this letter by sending this information to me in writing and Mike Horan of the DWQ Raleigh Regional Office. If we do not hear from you within three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
