PROJECT DESCRIPTION The project is located at 140 Yacht Basin Drive, adjacent to the Atlantic Intracoastal Waterway (AIWW), in Southport, Brunswick County. To find the project site, travel south on US Highway 17 to NC Highway 133 South. Travel approximately 23.75 miles south and turn left on to N. Howe St/NC Hwy 211.Turn right at the end of N. Howe St. onto W. Bay St. Travel approximately 0.2 miles to the end of W. Bay Street and the property will - be located on the left at the southeast corner of W. Bay Street and Yacht Basin Drive. The entire property consists of four lots totaling approximately 0.56-acres, which is located within the planning jurisdictions of Southport. The property is bordered by single-family residences to the west, the AIWW to the south and a vacant property to the east. An abandoned fish house is also located over open water to the west. According to the applicant, the property averages an approximate elevation of 0' to 4' above Normal High Water (NHW). The higlground is bordered by coastal and §404 wetlands to the south. High marsh vegetation consists primarily of Sea Oxeye (Borrichia frutescens), Common Reed (Phragmites australis), Salt Meadow Hay (Spartina patens), and Spikegrass (Distichlis spicata), with a depressed salt pan area located landward of a small berm where Smooth Cordgrass (Spartina alterniora) is also growing. The high marsh then transitions waterward to the berm where the vegetation predominantly consists of Sea Oats (Uniola paniculata), Goldenrod (Solidago sempervirens) and Sea Oxeye. Flooding of the wetlands onsite appears to originate from the adjacent property to the east, rather than over the berm and from the AIWW. Remnants of a concrete retaining wall remain near the coastal wetland boundary. The waters of the AIWW, adjacent to the project site, are classified as SA by the North Carolina Division of Water Quality. They are not designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries, and they are closed to the harvest of shellfish. PROPOSED PROJECT The applicant is proposing a 6-slip commercial docking facility, to excavate an upland basin accommodating an additional four boat slips, and excavation of an access channel and open water boat basin. The six-slip dock would consist of a pier, measuring approximately 70' in length by 6' in width, leading to a 62' in length by 5' in width T-head. A finger pier is then proposed at both ends of the T-head, each measuring 25' in length by 3' in width. A third finger pier is proposed as an extension of the pier, and would measure 24' in length by 3' in width. Four boat lifts are proposed within the four resulting slips with an additional two boat lifts proposed on the landward (northern) side of the docking facility. The boat lifts would measure 11.5' in length by 12.5' in width. Current water depths at the proposed docking facility, outside of the proposed areas of excavation, range from -2' to -11' at Mean Low Water (MLW). An access channel would be excavated west of the docking facility towards highground to allow access to the proposed upland basin. An additional basin area, measuring approximately 31' in length by 27' in width, would be excavated on the landward side of the docking facility, within slip 6 (See sheet 3 of 11). The proposed access channel would measure approximately 75' in length and would range from 21'-26' in width. The proposed upland basin to be excavated would be L-shaped and would measure approximately 86' in length by 26' in width with a 50' in length by 26' in width perpendicular extension to the east. All proposed excavation would be performed to a final project depth of -6' at Mean Low Water (MLW) and would be performed via buckei to barge. The shoreline within the upland basin would be stabilized by a single bulkhead to the north and west and a double bulkhead to the eastern and southern ends of the basin. The two bulkheads would be spaced approximately 6' apart. The upland basin would accommodate an additional four vessels. The waterward bulkhead would be aligned at or landward of the high water line, except for the area on both sides of the proposed entrance channel, where the bulkheads would extend approximately five feet below Mean High Water (MHW). Within the basin, two boatlifts, each measuring 11.5' in length by 12.5' in width, Cape Fear Landing Development, LLC, c/o Tom Covington Page Three would be installed in each of the two basin extensions. The entire site, as proposed, would accommodate a total of ten vessels. A six foot wide boardwalk is proposed around the perimeter of the upland basin and a 190 square foot uncovered platform would be constructed over high ground in the northern corner of the basin, between the two extensions. Approximately 97 linear feet of riprap is proposed along the waterward edge of the double bulkhead to the east of the entrance channel, measuring 10' in width. The riprap would continue onto high ground up to the coastal wetland line, east of boat slips 7 & 8. Spoil from the proposed excavation would be located on the remaining high ground portion of the property, outside of the 30' buffer. Dimensions of the, spoil area would measure approximately 120' in length by 120' in width. After spoil dewaters, it would then be trucked to 2064 Smithtown Road (Parcel #'s 1860000905 & 186000090). This site is located at the corner of NC Hwy 211 and Sunset Harbour Road. The spoil would be located on the side of the property adjacent to, and accessed from, Sunset Harbor Road (see Sheet 11 of 11). A letter of authorization has been submitted from the property owner allowing the applicant to place the spoil on site. Dimensions of disturbance on this secondary spoil site would be approximately 200' in length by 200' in width. 10. ANTICIPATED IMPACTS The excavation of the proposed upland marina basin would impact approximately 334 sq. ft. of coastal wetlands and approximately 3,335 sq. ft. of high ground. The proposed access channel and open water basin would impact approximately 2,472 sq. ft. of shallow bottom. Approximately 565 cubic yards of material would be excavated from below MLW and 1,760 cubic yards of material would be excavated from high ground. Approximately 126 sq. ft. of coastal wetlands would also be shaded by the six foot wide boardwalk to be constructed around the basin. Approximately 498 sq. ft. of high ground would be filled as a result of the double bulkhead construction. Although no bulkhead backfill is proposed landward of the upland basin, additional indirect impacts of the coastal wetlands to the north could possibly result from the construction of the bulkhead due to a potential change in hydrology. Similarly, coastal and §404 wetlands could also be impacted due to the riprap proposed at the eastern end of the upland basin, as it is located waterward of the existing wetlands at an approximate height of 5' above the high water line. Approximately 512 square feet of shallow bottom would be impacted from riprap placement. Approximately 388 square feet of riprap would be placed above the high water line, waterward of the bulkhead. Excavating to a depth to -6' at NLW with a box cut could adversely impact the adjacent fish house structure located immediately west of the project area as support pilings are located within the predicted sloughing area. Plans show a loss of 2' of substrate around these pilings due to sloughing. The proposed pier and six-slip docking facility would incorporate approximately 2,740 sq. ft. of Estuarine Waters and Pubic Trust Area. The proposed docking structure would not encroach into the adjacent 15' Riparian Corridor Setback Areas, nor into the US Army Corps of Engineers setback and would extend approximately 95' into the waterbody, which measures approximately 3500' across, and thus meets the'/4 width rule. Increases in turbidity should be expected during construction. The spoil disposal would result in the disturbance of approximately 12,725 square feet of high ground on the site and approximately 40,000 square feet of disturbance at the final disposal site. This CAMA Major Permit Application specifically proposes a six slip open water docking facility, a four slip upland basin and associated access pier, docks, boardwalks, 190 square feet of open decking, bulkheads and riprap. Existing parking is available at the site. The site is located adjacent to the Cape Fear River, Southport, Brunswick County, North Carolina. Access to the upland basin will be provided by a channel varying in width from twenty one to twenty six feet wide by seventy five feet long dredged to -6 MLW. No hydraulic dredging is proposed. Excavation of the upland basin impacts 333.5 square feet of insignificant coastal wetlands. See sheets 8-10 of 11 for representative photographs. No 404 wetlands will be impacted. See figure 3 of 11 for temporary spoil staging area. Temporary spoil staging area will be contained by silt fencing. See figure 11 of 11 for permanent spoil disposal area, located at 2064 Smithtown Road, Brunswick County, NC (Parcel #'s: 1860000905 and 186000090) approximately 10 miles from the site. Waters of the Cape Fear River in the vicinity of the subject property are classified as SC. There are no floating structures proposed. All docks and piers will be fixed. All slips will be lift slips. All proposed structures are located outside of the USACE 80' setback. The width of the water body is approximately 3,500 feet. The one quarter water body width is therefore beyond the scope of the plan drawings for the project. The site is currently undeveloped with the exception of an existing parking area, a -1- concrete retaining wall and pilings from previous docking facilities. Standard marine construction methodologies will be used.
