The Division of Energy, Mineral and Land Resources (DEMLR), received your letter dated March 28, 2018
in which you ask that DEMLR perform a courtesy review of a proposed development on behalf of the
Town.
The division can provide an informal courtesy review to confirm compliance with state Phase II
regulations. However, the Town is responsible for performing the official review and permitting in
accordance with the Town's stormwater ordinance and Phase II permit.
Your permit requires that you provide adequate funding and staffing resources to implement all aspects
of the permit, including review of developments under the Town's post -construction stormwater
ordinance. This may also be implemented by another local government via an interlocal agreement, or
by a private consulting firm under contract by the Town. The construction stormwater (erosion &
sediment control) program is the only part of the permit that the division has the regulatory framework
to implement for local permitted MS4 programs.
Please provide me with a schedule, by April 30, 2018, for the Town to implement an appropriate plan
for the post -construction program locally.
