PROJECT SUMMARY: The applicant proposes to add two floating docks to the existing facility and perform maintenance dredging around the existing boat ramp and boat slips. Oyster Harbour, LLC Page Two 9. PROJECT DESCRIPTION Carolina Marine Construction, Inc., on behalf of Oyster Harbour, LLC, has requested that the attached application be processed under the Express Permit Review Program. Development of the Oyster Harbour subdivision and docking facility was approved under CAMAlDredge and Fill Permit No. 145-03, on October 16, 2003. Prior to expiration of the permit on December 31, 2006, the permittee completed all development activities associated with the permit request. No additional work has taken place at the site since expiration of the permit. Currently, the applicant is seeking approval to maintain water depths at the terminal end of the existing boat ramp and docking facility, and to construct two additional floating docks. A field investigation report (FIR) was prepared for the subject facility by Janet Russell, on 9/30/02. Activities proposed as part of the initial project included: construction of a subdivision with amenities, including but not limited to a parking lot, playground, deck, gazebo, bulkhead, boat ramp, pier, and a nine-slip docking facility. The project site is located at the end of Boones Neck Road SW, in Supply, Brunswick County. The subdivision is located on the mainland side of the Intracoastal Waterway from Holden Beach. Oyster Harbour borders the Shallotte River to the west, Windy Point Road to the south, Boones Neck Road to the east and private property to the north. To fmd the property from the Wilmington Regional office, take Highway 17 South towards Myrtle Beach. Turn left onto Mt. Pisgah Road SW and continue south approximately 5.5 miles (Mt Pisgah road turns into Holden Beach Road SW). Turn right onto Boones Neck Road SW, from Holden Beach Road SW, and travel west approximately 3.5 miles, or until you reach the end of Boones Neck Road. The subject site will be located at the terminal end of the road, on the right hand side. The subject parcel, or tract, is located on the southern side of Windy Point Road, and borders the Atlantic Intracoastal Waterway (AIWW). The parcel is approximately .9 acres in size and is located at the intersection of Boone's Neck Road SW (SR 1137) and Windy Point Road (SR 1138). The property has approximately 140' of road frontage on Windy Point Road and approximately 99' of shoreline along the AIWW, all of which is bulkheaded. The coastal marsh along the southern shoreline is approximately 50' to 60' wide and species include: Juncus roemerianus and Martina alterni ora. The property slopes from the road towards the AIWW. Vegetation on the tract primarily consists of weeds, lawn grasses, and live oak trees. The project borders the waters of the AIWW which have been classified as SA by the Division of Water Quality. The Division of Marine Fisheries has not designated this area as Primary Nursery Area (PNA). The nearest PNA is located'/2-1 mile to the west nearer to the mouth of the Shallotte River. The project area is open to the harvesting of shellfish. Existing water depths from the shoreline to the docking facility range from 0.0' to -3.0', relative to normal low water. PROPOSED PROJECT As proposed, the applicant is requesting approval to install two, 3'x 13' sections of floating dock along the southern side of the existing dock spine, relocate five (5) existing tie pilings and perform maintenance dredging around the toe of the boat ramp and docking facility. The main portion of the docking facility is comprised of a single 6' x 53' section of floating dock that runs parallel to the shoreline, approximately 150' waterward from the edge of Normal High Water (NHW). In addition, a 3' x 20' finger dock is located along the eastern end of the 6' x 53' floater. The finger dock was originally constructed to allow for transient dockage during vessel deployment associated with the adjacent ramp; however, the applicant indicates that safety concerns warrant the installation of a new access ramp approximately 20' from the terminal end of the access pier. The access ramp would bridge the access pier and boat ramp, and would allow for safer passage between the two structures at times when waterway traffic is heavy. Oyster Harbour, LLC Page Three In addition to the ramp, the applicant is also proposing to install two, 3' x 13' finger docks in the center, and along the far western end of the floating spine. The finger docks would span towards the south and would terminate landward of the existing pier-head line. The proposed finger docks would replace five existing piling that currently divide the boat slips. The existing pilings would be relocated to the landward side of the "spine" where they would serve as support for the floating structure. Lastly, the applicant is proposing to dredge around the terminal end of the boat ramp (50' x 60') and around the outer perimeter of the docking facility (50' x 36'). Current water depths average -1.5' to -2.0', relative to normal low water (NLW) in the vicinity of both structures and the applicant is proposing to increase the depth to -3.5 to - 4.0', NLW. The previous CAMA/D&F permit allowed the applicant to extend the ramp beyond the existing location which would have eliminated the need to dredge; however, the ramp was terminated short of the approved alignment in order to save money. Boat wakes and shoaling have resulted in a hindrance to navigation and the area is in need of reconditioning. Approximately 356 cubic yards of material would be removed (by a bucket and barge operation) and transported to high ground via the boat ramp. The material would be dewatered on the barge and placed within the subdivision, in a designated area adjacent to the tennis courts. The disposal site (100' x 100') appears to be void of any wetland vegetation. Please refer to Page 1 of 3, dated 12/20/08, for detailed view of the dredge footprint. 10. ANTICIPATED IMPACTS: The installation of the finger docks and ramp would incorporate approximately 78 sq. ft. of estuarine and public trust waters. Additionally, the proposed maintenance dredging activities would result in the dredging of approximately 4,800 sq. ft. of previously disturbed shallow water area. Disposal activities would result in the disturbance of approximately 10,000 sq. ft. of high ground. As proposed, the planned development would not encroach within the 80' COE setback, nor would the structures extend beyond'/4 of the width of the water body. Minor increases in turbidity are expected during dredging; however, no long term impacts are anticipated. Once the deficient items have been addressed, please mail the additional items to our office or feel free to drop it off. deficient items: 1) Please provide a detailed drawing of the proposed disposal site including the general location, size, proximity to any open water areas (AIWW or tidal creeks), the 30' buffer and 75' AEC if applicable. Also, I really need a wetlands boundary survey showing that there are no "404" type wetlands in this location. The OH POA should have a copy of the survey on file showing any federal wetlands. 2) On the MP-2 Form 5.) d.) i.), please change.to sta_te_that no_ wetlands will be crossed transportine equipment to the protect site. If I'm reading this correctly, all of the dredge material is going to be off loaded using the existing boat ramp. Unless you are crossing naturally vegetated, undeveloped and unaltered coastal wetlands, I would recommend leaving this section as "NO". If I have a misconception of what is planned, just leave it the way it is. I'm just trying to take any concerns away from the other resource agencies. 3) On the Structures Form, you state there are three (3), 3' x 20'U-1(} sections of dock proposed and one (1), 4' x 16Olatform proposed, however the Page 3 of 3 shows two, 3' x 16' finger piers, one 3' x 20' finger pier and a 6' x 16q''4access ramp. Need to either revise the plans or l change the e the two consistent. Based on the drawings, it application package to ma appears as though the two outer finger piers will be limited to 16' or less due to the locat ion of the 80' channel setback. On a side note, it may be that the Page 3 of 3 is not drawn to a 1"=40' scale.... Double check it and revise if it's off. 4) In relation to the proposed finger piers, it looks as though they are over their square footage allotment based on the amount of shoreline t hey have. If they have 99 linear feet of shoreline, then they are allowed 396 sq. ft. (4 sq. ft. per linear foot of shoreline) of platform or dockage. As proposed, they have 498 sq. ft. of platform or docking space. You'll need to see if they won't scale back on some of the finger piers to meet the 4 square foot rule. Otherwise, we won't be able to authorize the work without a variance. Call me if need to discuss this further. PMB:326 Wilmington, NC 28412 910-793-4143 fax 794-9909 February 23, 2009 To: DEH & NR Re: Oyster Harbour The current docking facility that the developer left for the homeowners at Oyster Harbour Waterway Park is very difficult, if not dangerous to use. The distance between the boat ramp and the floating dock / pier is too far to launch even a john boat by yourself. The wakes created by vessels on the waterway either will swamp your boat (if left unattended) or your truck and trailer. If you choose to dock your boat, you have to run back up the pier and down the boat ramp to move your vehicle. The proposed crosswalk would eliminate much of the time needed to get from the pier to the boat ramp or vice-versa. The addition of the finger docks will aid in the ease of docking, loading and unloading of the boats. The north and south current of the waterway makes it very difficult without the additional finger docks. The maintenance dredging is to allow for the launching and retrieving of boats at low tide. Over time silt and sand have filled in the original dredged area. We are proposing the maintenance dredge to keep the facility operational. All of the items that are proposed are to make the current existing docking facility safe and easy to use. A large number of the homeowners would like to utilize the dock and ramp for recreational boating but have been able to do so effectively. The proposed additions will remedy all of their issues.
