Director Division of Water Quality Date: To: Number: From: Sarah Young, Division of Water Quality Subject: Public Notice Pages: 1 The Town of Nashville has been designated by the US EPA for inclusion in the Phase II stormwater program. The Town of Nashville was designated because their municipal boundaries intersected a US Census -defined Urbanized Area. On July 12, 2004 the North Carolina General Assembly ratified Senate Bill 1210 (S1210) - Phase II Stormwater Management. The Governor signed the bill on August 2, 2004. This bill addresses implementation of the federal NPDES Phase II stormwater program in North Carolina. In S1210, the General Assembly provided a framework that will allow state and local government agencies to begin implementing the program. The bill establishes minimum stormwater management requirements for municipal storm sewer systems and also applies stormwater controls to some developing areas around these municipalities. The Division has received submittals from 123 municipalities and 33 counties. Submittals include applications for permit coverage, requests for waivers from coverage and certifications that the local governments do not own/operate a storm sewer system. Please publish only the information (Public Notice) below, ONE TIME in the legal section of your paper by Tuesday, July 26, 2005. Within 10 days after publish date, please send the invoice and two copies of the original affidavit to: Sarah Young NCDENR/DWQ Stormwater Permitting Unit 1617 Mail Service Center Raleigh, NC 27699-161 The Town of Nashville has applied for an NPDES Phase II Stormwater Permit to discharge stormwater from their municipal separate storm sewer system (MS4) located within the Town of Nashville jurisdictional area, Nash County, to receiving waters, Stoney Creek and unnamed tributaries, Sapony Creek tributary, and Gust Branch of Spony Creek, within the Tar -Pamlico River Basin. All comments and request should reference draft permit number NCS000485. Comments must be received no later than September 2, 2005.
