Dear Mr. Rose:
On March 5, 2009,the Division of Water Quality(DWQ)received your application dated March 5, 2009
to impact 1,369 square feet(ft)of Zone 1 protected riparian buffers and 1,899 square feet(ft)of Zone 2
protected riparian buffers to construct the proposed stormwater outfalls at the subject property . The
DWQ has determined that your application was incomplete and/or provided inaccurate information as
discussed below. The DWQ will require additional information in order to process your application to
impact protected wetlands and/or streams on the subject property. Therefore,unless we receive five
copies of the additional information requested below,we will place this project on hold as incomplete
until we receive this additional information. If we do not receive the requested information,your project
will be formally returned as incomplete. Please provide the following information so that we may
continue to review your project.
Additional Information Requested:
1. In order to meet the requirements associated with Condition 9 of the 401 Certification that was
issued for this project on August 31, 2005,you must provide documentation of the City of
Raleigh's approval of the stormwater management plan for this project by providing EITHER:
• A valid approval letter from the City of Raleigh indicating that the proposed activity has an
approved SMP and one copy of the approved SMP, including plan details, calculations and
other supporting information, OR
• A set of stormwater plan details and calculations stamped as "Approved"by the City of
Raleigh.

information to me and to Lauren Witherspoon of the DWQ Raleigh Regional Office. If you will not be
able to provide the requested information within that timeframe,please provide written confirmation that
you intend to provide the requested information,and include a specific timetable delineating when the
requested materials will be provided. If we do not hear from you in 30 calendar days, we will assume that
you no longer want to pursue this project and we will consider the project as returned.
This letter only addresses the application review and does not authorize any impacts to wetlands,waters or
protected buffers. Please be aware that any impacts requested within your application are not authorized(at
