4a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:*
The project site is a mostly undeveloped property. Recent clearing, grading, and filling activities in preparation of
site development occurred during the winter of 2017-2018. One perennial stream, Brown Branch, flows west
through the project site. An unnamed intermittent tributary to Brown Branch, UT -Brown Branch, flows from off-site
and north through the project site. Three wetlands are located within the project site, Wetlands AA, BB, and CC. A
temporary 20 If HDPE is placed in Brown Branch and a 220 If HDPE is placed within UT -Brown Branch beneath an
approximate 1 -acre area of fill.

4f. Explain the purpose of the proposed project:*
There are two purposes of the project. The first is to prepare the site for future commercial development. The
applicant is in the process of working on an approved site plan. The second purpose of the project is to restore
wetlands previously impacted by earlier site development activities, as well as, remove previously placed culverts
in waters of the U.S. The goal is to bring the project into compliance with rules under the Clean Water Act of 1972.
4g. Describe the overall project in detail, including indirect imapacts and the type of equipment to be used:
The project proposes direct impacts to jurisdictional waters of the U.S. under Nationwide Permit (NWP) No. 39.
Previous site development activities resulted in non -authorized temporary and permanent impacts to waters of the
U.S. The applicant is not aware of any Section 404/401 permits for project related activities. Therefore, this permit
application will cover After -the -Fact impacts to waters of the U.S. One previously installed HDPE culvert will result
in permanent stream impacts for site access and development. Other stream and wetland impacts from site
development are temporary and will be mitigated by permittee responsible restoration outlined in the attached
Corrective Action Plan (CAP).
Crossing One
Stream Impact S1 — Stream A, Brown Branch
An existing 20 -foot 36 -inch high density polyethylene (HDPE) culvert is temporarily placed within Brown Branch.
The culvert was used by heavy equipment to cross Brown Branch during site clearing. The culvert will be removed
and the daylighted channel will be restored as outlined in the CAP. Additional temporary stream impacts will occur
during the pipe removal and stream restoration activity resulting in 6 -linear feet of temporary fill (S1) for the pump
around operation, so that work can be completed in the dry. Equipment operation for the culvert removal will be
completed from the stream banks. Following culvert removal, stream bank restoration will include reshaping the
banks to original contour and slope, matching upstream and downstream patterns. Stream banks will be matted
and seeded.
Crossing Two
Stream Impacts S2 and S3 — Stream B, UT -Brown Branch
An existing 220 -foot 18 -inch HDPE culvert will be utilized for a permanent road crossing and site development
during grading for a new construction pad. To avoid mitigation, the applicant, as outlined in the CAP, will remove
71 -linear feet of existing pipe (temporary fill) and restore the daylighted stream reach (S2). Culvert removal will
occur outside of the trout moratorium. Additional temporary stream impacts will occur during the pipe removal and
stream restoration activity resulting in 6 -linear feet of temporary fill (S2) for the pump around operation, so that
work can be completed in the dry. Equipment operation for the culvert removal will be completed from the stream
banks. Following culvert removal, stream bank restoration will include reshaping the banks to original contour and
slope, matching upstream and downstream patterns. Stream banks will be matted and seeded.
By completing the proposed culvert removal and stream restoration, the remaining culvert will result in 149 -linear
feet of permanent fill in UT -Brown Branch (S3). The existing HDPE culvert is currently countersunk at least 3.6 -
inches below stream channel bed meeting the 20% embedded requirement. New stacked rock headwalls will be
constructed on the inlet/outlet ends of the culvert to control grade from surrounding fill. No riprap outfall protection
is proposed due to the very low gradient of the stream system and presence of grade control in the stream

Trout Buffer Clearing
Brown Branch
Approximately 200 -linear feet of trout buffers were cleared during previous site development activities. The CAP
proposes to install live stakes directly in the banks of Brown Branch in addition to installing bare root trees and
shrubs within the adjoining portions of Wetlands AA and BB (restoration activities for wetland impacts W1 -W5).
Live stakes will be spaced at 4 -feet on center; bare root shrubs and trees will be spaced at 10 -feet on center.
Approximately 100 live stake plants will be installed within cleared stream banks; approximately 250 bare root trees
and shrubs will be installed in the cleared portion of the trout buffer. Bare root and live stake installations will occur
within the 2018 seasonal dormant period. Permanent riparian/wetland seed mixes will be broadcast within cleared
buffer and wetland areas. These buffer and wetland restoration activities will ensure that the vegetated community
is re-established and the trout buffer clearing activity is appropriately mitigated.
Wetland Clearing
Wetland Impacts W1 — W5, Wetlands AA and BB
The removal of forested vegetation and disturbance of herbaceous vegetation occurred within the boundaries of
Wetlands AA and BB by the project owners as part of site development during the winter of 2017-2018. These
actions temporarily impacted 0.78 -acre of jurisdictional wetlands (Impacts W1 -W5). Wetland impacts W1 -W4
represent clearing/grubbing impacts to forested and herbaceous wetland areas, whereas wetland impact W5
represents both forested clearing impacts in addition to filling (0.03 -ac fill). An approximate 0.78 -acre area within
Wetlands AA and BB, disturbed by previous land development activities, was composed of a 0.62 -acre forested
wetland area and a 0.16 -acre herbaceous wetland area.
The CAP proposes to install bare root trees and shrubs within previously disturbed forested areas matching
surrounding wetland vegetation communities used for reference species and spacing considerations.
Wetland/riparian seed mixes will be applied to disturbed forested and herbaceous areas according to designer
approved techniques. Approximately 250 bare root plants will be installed. Bare root installations will occur within
the 2018 seasonal dormant period.
Wetland Filling
Wetland Impact W5, Wetland BB
The property owners began preparation of the project site by adding fill material for increasing site grade and to
establish a construction pad for future commercial development. This work was performed prior to having a
wetland delineation completed. CWS completed a stream and wetland delineation on March 5, 2018 that included
flagging wetland boundaries. Approximately 0.03 acre of fill material is estimated to have been placed within the
Wetland BB boundary, within a previous forested wetland community (Impact W5). Remedial actions will include
removing fill material, re-establishing pre-existing wetland contour, and replanting the forested wetland. Fill will be
mechanically removed and matched to surrounding wetland ground elevations in unfilled areas. Wetland flagging
will guide the operator to the extent of fill needing to be removed. Depth of fill removal will be gauged by color
changes of soils. The natural wetland soils are very dark in contrast to the fill material which can be discerned by
its bright red to yellowish color. Following fill removal, adjoining upland areas will be graded to a stable gradient
outside of the wetland boundary. Long-term site development will include use of a retaining wall to maintain site
grade in areas adjoining the restored wetland boundary. Wetland areas where fill material has been removed will
be replanted and seeded according to actions described in the wetland clearing restoration for Impacts W1 - W5.

Act. Future phases will include commercial site development. Site planning is being completed by an engineer and
will be in accordance with county, state and federal rules, ordinances, and regulations. If future phases propose
impacts to waters of the U.S., all impacts will be counted cumulatively. There is not a completed site plan to date.

Two culverts have been installed on the project site during previous site development activities. One culvert will be
completely removed and the stream channel within its footprint will be restored according to the attached CAP.
The second culvert will be shortened and a portion of the culvert will be left in place to accommodate future
development. Stream channel will be restored within portions of the removed culvert sections according to the
CAP.

The applicant will follow actions presented in the attached CAP to bring previous site development activities into
compliance with rules under the Clean Water Act. An eAsting culvert proposed to be left on the project site is
currently countersunk 20% of the pipe diameter below stream bed elevation, thus supporting aquatic life
movement. The same proposed remaining culvert already matches the stream channel width; therefore the culvert
will maintain low flows and a hydrological connection to downstream waters during low flowing time periods.

Previous site development activities that resulted in temporary wetland and stream impacts will be mitigated by
owner responsible restoration activities per the attached CAP. Site stabilization of upland areas will be completed
according to the CAP that will prevent potential water quality violations. Proper sediment and erosion control
measures will be used to minimize disturbances to downstream waters. Construction activities and impacts to
waters of the U.S. will comply with all conditions of Nationwide Permit No. 39 and Water Quality Certification No.
4139.

Unauthorized fill within steams and wetlands, as well as, mechanical clearing of wetlands occurred during the
winter of 2017-2018. A letter of Unauthorized Activity/Permit Noncompliance was issued by the USACE on
February 26, 2018 (attached). A Corrective Action Plan is being provided, and the owner will be completing
restoration activities according to the CAP to offset mitigation requirements.

Past impacts to waters of the U.S. are being addressed through this PCN application for a NWP No. 39, as well as,
restoration activities per the attached CAP. Future development activities are being planned by the owner in
cooperation with an engineer. The engineer will be using the wetland delineation to minimize potential impacts to
waters of the U.S. during the site planning process. It is not known whether future impacts to waters of the U.S. will
be unavoidable. If necessary, future impacts to waters of the U.S. will be permitted through the 404/401 program
and will be counted cumulatively.
