The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore,unless we receive five copies of the additional information requested below, we will place this project on hold as incomplete until we receive this additional information. If we do not receive the requested information,your project will be formally returned as incomplete. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. As noted on page 2 of your narrative, drainage of a buffered pond is exempt provided that a new riparian buffer is established. You must comply with the Tar-Pamlico Buffer Rule(15A NCAC 213.0259)and with the attached Buffer Clarification memo#2007-012, in that once a pond is drained, buffers must be replanted along the newly formed stream channel. Someone from the DWQ Raleigh Regional Office must make an on-site determination as to the extent of the new buffers. Generally you must wait six months after the pond's dam has been breached prior to requesting the onsite determination from DWQ to give the drained pond time to form a stream or wetland. If it is determined that a stream has formed in the drained pond,you must replant the buffer in accordance with the required 320 stems per acre at maturity and maintain diffuse flow through the buffers in order to qualify for the exemption. Please respond in writing within 30 calendar days of the date of this letter by sending a copy of this information to me and to Lauren Witherspoon of the DWQ Raleigh Regional Office.
