As we had discussed we are proposing to resurface existing gravel roads with asphalt (some include curb & gutter) and provide stormwater improvements as needed in various locations all over Durham. These roadways will remain open and maintained as gravel during construction to allow residents/businesses to access their property. We feel that these areas are exempt from buffer authorization because existing uses are present and ongoing per 15A NCAC 02B .0233.3.b and 15A NCAC 02B.0267.6. If that is the case we will need confirmation from DWR in writing to obtain our Soil and Erosion Control Permit from DWQ. If, however, DWR determines buffer authorization are required we have completed and attached the appropriate forms for the four (4) streets that are affected. Please note that the Army Corps has reviewed our project and acknowledged that our project falls under the Nationwide Permit 3 for maintenance as a non -reporting permit. We have enclosed a copy of the USCE email to us and have highlighted this response (see email dated March 9, 2018 from Roscoe Sullivan of USCE to Tim Watson City of Durham). After our discussion, I went to our stormwater division and asked about the stream determination you mentioned. They reviewed our proposed project and based on their experiences these types of modifications have been classified under the NWP-3 Maintenance paragraph (a) as we are not proposing any new impact to any stream. For clarity I've attached a markup up of our plan with pictures at each of the four locations and ask that you confirm that we are covered under the NWP-3 permit for maintenance and also confirm that notification is not required as that only applies to paragraph (b). The photos in the markups were taken on February 22, 2018 after approximately a 1/2" of rainfall over the previous week. Location 1: Brunson Street - Upgrading culvert system to accommodate the requirements of the City of Durham stormwater regulations. Location 2: Chalmers Street - Realigning culvert system to accommodate the safety of the existing houses that are located along the existing culvert. Location 3: Leonard Drive - Upgrading culvert system to accommodate the requirements of the City of Durham stormwater regulations at both stream locations. (2 pages) Location 4: Omah Street - Adjusting culvert system to accommodate the requirements of the City of Durham stormwater regulations.
